But if it ends up being challenged it has to justify why. Saying "oh it is because of his legal situation" is fine but then a court is entitled to ask "well why didn't you suspend him." I don't disagree with what Florio said in September. I think the thing is at that point everyone was banking on the status quo lasting the year and if that had indeed happened then just letting him sit on the Texans bench made sense. Plenty of high profile organizations have suspended or cut ties with an employee when so many allegations like this have surfaced. You have to consider the current climate when it comes to this topic as well as the sensitivity to this issue. Their GM is in his 4th or 5th season and the rebuild looks like a total failure right now so I’m guessing the seat is getting pretty hot.
