Favre netted them only a 4th, which became a 3rd conditionally, and only the year later in 2009 (could have become a 2nd if the Jets made the playoffs and a 1st if they made the SB). Any player could retire at any time or get injured or suddenly suck. Why should the trade trading for the contract get any protection?
