Marc Miller (Dallas is Going Down) trying to cash in on the Bills

 I believe that Resurgence had brewed and distributed another batch of the  "Dallas Is Going Down, Gary" beer a week or two ago, following Miller's objection to Resurgence's use of his likeness, so whatever differences they had seemed to have been put aside - at least for now.

he's now doing promotions for them so they have come to an agreement it seems

I also don't get the animosity here. The Bills are a billion dollar company and used the guy in a commercial to sell a couple million dollars worth of tickets.

 

 

 

 

 

He should have went about it n a professional manor and not act like a dick on Twitter, thats the problem here.

“They decided, without my permission, to put a likeness of me on that can of beer,” Miller said. “I was told they sold out of the beer and everything the day they did their introduction of that type of beer. I thought it was very distasteful. Number one, I don’t drink. Not that I’m against alcohol, it’s just never been in my life.”

 

He said he was told by that company they didn’t need to have his permission to use his likeness.

 

“Well I think you’re gonna have a problem with that one legally,” he said. “It’s just not cool to do that in my opinion. I would never take advantage of a client or person for monetary gain. I just wouldn’t do it. To me, it’s just a shame on you for doing that.”

 

He also was caught off guard when the Buffalo Bills used his likeness to promote ticket sales in a commercial.

 

“They should call me and give me a suite or something,” Miller quipped. “You can’t just take a likeness of someone and use it for promotional gain. Unless you’re gonna let me use Josh Allen on my website to promote my company.”

 

I'm pretty sure, "It's not cool," is not the legal standard here.....

Exactly and I agree with @Gugny the Bill didn't sell millions of dollars of tickets because of a screaming moron in a ad

The Bills have streamed that video millions of times this year. His clip certainly had value, or why else would they have chosen to use it in the 30 secs they dedicated to advertising?

 

I'm really interested in finding out how they aquired it, and if Mark had signed his rights away. If he did, he has no ground to stand on. But if he didn't sign his rights away to the original news broadcast, then he's entitled to a usage fee. And believe me, the fee is always way higher after it's been viewed by a mass market.

I'm surprised the Bills used the clip.  I don't think the guy has any legal or financial standing here, but I thought the Bills were heading in a classier direction, trying to reign in the table smashing and other foolish, drunken tailgating behavior.

 

To use that clip as a ticket-sales promo is saying,  "We approve of and condone some drunken turd-head getting all turd-faced and acting like a complete idiot."

You know what's funny, the name of the show Marc was featured on was called "George Michael's Sports Machine." I think Marc misspoke and called him Gary instead of George.

 

And I'm personally interested in it because i work in advertising / video production. I see what people get paid to appear in ads, and I license video clips all the time... How much do you think the Bills paid their ad firm to produce that commercial?

It's weird to me that people are against this. 

 

Companies are using his likeness to promote their brand, without his permission. It's an open and shut case IMO. They're using him for their personal gain. 

 

There's nothing wrong in wanting to be properly compensated. Is there a tint of jealousy here somewhere? Is it because he's a working/middle class guy like most people here, trying to make some money? He already gave so much in that interview, and has brought so much joy to anybody watching it. What does it say about the city of good neighbors when they want to take, but don't want to see something given back? Are you afraid he's going to make more money than you?

Supposedly the guy does not drink, and was not drunk at the time. And I can buy that. Millions of sports fans don't need alcohol or drugs to act like this guy did. Also, you insulting him really doesn't say a lot for YOU.
