In some states he could have been legally shot. It is trespassing no matter how you look at it. He was not drunk either. He was high on something or mentally ill. He was identified by the guy at the house. Guessing he pleads to some lesser charge and pays a fine and community service. Do you live in an area where it's normal to have someone on drugs come into your house at 1am? Some parts of the country he would have been shot. He's lucky to be alive.
