Yes, because DraftKings made the call to cancel the game.

 

Makes total sense. As long as they didn't pocket all the bets, how can he seek damages from something outside their control?

You obviously didn't read what was posted. I suggest you click the second link and read. If what is said is true he must certainly may have a case.

essentially. DK voided all bets and returned bettors’ money.

 

edit: I am only speaking to bets on their sportsbook, not their daily fantasy contests, which is a separate app and apparently the issue the plaintiff has.

yes I edited to add that clarification. Still don’t think it goes anywhere, as I would assume there are different terms and conditions for contest bets placed on the sportsbook as opposed to daily fantasy contests or “flash” bets.

I did read it, that's where I got the quote from. The first link doesn't work for me, so if there was some revelation in there, I definitely missed it.

The man suing says they broke their own rules regarding suspended games, but... A) what are their rules on a suspended game, and B) the game was only temporarily suspended, but ultimately canceled outright, with no intention of a makeup. 

 

Then it all becomes obvious why this is even a thing... He was in first place at that point, then "poof," NFL cancels game. He got his money back, as did others. Your opinion might be that he has a case because DraftKings honored payouts in other types of contests, but we have zero clue what those contests entailed, what their individual rules were, or how extensive that was. 

My opinion comes from seeing how many lawsuits fail or get thrown out, despite far more egregious issues than this. People sue for anything & everything, but it rarely ever works out. It's very difficult to prove damages, and likely even more so when it involves gambling. You could be right, and I could have no clue, but it's what I believe.

I made some $10 and $20  bets at the start of the season on which QB has the most passing yards for the season including Allen and Burrow.  It has been Mahomes in a runaway(unless he got hurt) for several weeks now.  I was surprised that my bets on Allen and Burrow were voided and my money refunded.

If true, DK did put themselves in a pickle.  I don't know how they can justify using stats from the game in some instances and not others.

Hmmm 🤔... Let's see... Some might say

 

   If you're into Fantasy Football to the point you feel the need to hire a lawyer to commence a civil suit, ya might just have a problem.

   If you're the only one in your fantasy football league who's suing, cause others are letting it slide, it's possible ya have a problem.

   If, as the article says, they refunded you you're money but your suing to be declared the winner of your Fantasy Football league, someone might think ya have a problem.

   If you're willing to spend all the time & money necessary on a lawsuit over a colossal $5K prize, sounds like ya have a problem. (& If you're suing for additional "pain & suffering" on top of that, then hell son, ya got a problem)

   & If the Game was cancelled bc a player nearly Died live on national TV, galvinizing the nation into an unprecedented outpouring of love & support, and your priority is it's effect on your fantasy football game, maybe just maybe ya have a problem.

   Maybe I'm completely wrong there's no gambling problem & he's just a cynical, cold hearted, business man, who will sue anyone he feels has wronged him or treated him in anyway unfairly to get every last dollar he thinks he deserves, kind of like Ebeneezer Scrooge.

 

   Either way, I don't really care, just thought the article was interesting & yes IMO the person sounds nuts. But to each their own. Just glad Hamlin's ok. Go Bills! 😉
