According to his attorney, it wasn’t a beer can, it was a can for spitting tobacco into and it wasn’t found between his legs but in the vehicle door instead. I don't recall. I have a vague recollection of it being talked about as the reason he might have had an open beer can in his car. He could have had it for protection while 4-wheeling and safed it for transport. Second, carrying a loaded gun in Texas is legal. You're welcome to believe it's idiotic, but a lot of people carry legally and they aren't all idiots per se - it's considered a legal right in this country (whether that's a good idea is a whole 'nother topic) The report that Oliver had an "open beer can between his legs" has been disputed by Oliver, and later reports were it was found in the door of the car. If the safety is on, it’s not a big deal. From all of my dating down here in the south before and then after marriage, guns are pretty darn common in the south with women I’ve dated. As a girl named Rosemary from GA told me, no self respecting southern girl is never without a gun in the car. my only problem since he really was sober is if he more likely had an open container was stupid, wreck less, and if true would at least be charged with a misdemeanor. His lawyer said the beer can was not retained as evidence, and that it's in his (the lawyer's) possession with the chaw still in it (yuckkk) I think that there says it. I think it was in the report there was a beer can visible to justify probable cause to perform the field sobriety test and get the blood tests, but they didn't keep it because it didn't contain beer. From working in south I know it is not uncommon for bottles/cans to be used as spittoons to have leftover drink in them. A Master Sgt. I used to ride with used one for both butts and spitting both chewing and dipping tobacco. When I rode with him he said if you had an issue with tobacco get another ride but he always had his window open and even had a spot on jeep door to put his cigarette and (I was told) cigar.
