He may very well play against us week 4. If Brady asks the 2nd Circuit for en banc review, it could take a couple months before the Circuit renders a decision. Even If the Circuit denies Brady's request quickly, Brady will almost certainly file a cert petition with SCOTUS. Briefing wouldn't likely be completed until the fall, and in any event SCOTUS won't start conferencing cases until the fall session sometime in October. They break in June for the entire summer. I think there is a good chance that Brady will get a stay while this litigation is going on, meaning he will be active for the game against the Bills.

 

I think the 2nd would deny his request for en banc review immediately. If he wastes his time and money petitioning for Supreme Court review (which the SC will deny), that would be hilarious (and futile) and further demonstrate the arrogance of Brady.

Good. Too bad his restructure removed almost all of the financial penalty.

 

So in other words he pretty much losing nothing by missing the games, at least in the eyes of the court. Why would they care if he actually gets to play in a game or not? He's not some 20-something playing for his next contract so it doesn't matter one bit to his bank account if he misses games or not. A stay seems kind of pointless. If by some chance down the line he actually wins on an appeal, they could just give him back his game checks and he hasn't really lost anything at all.

While the chances of relief from SCOTUS are extremely low, Brady might seek cert just to delay the suspension. The Pats might think it is better for him to not the miss three home games at the start of the season.

Although it is possible that the Circuit and SCOTUS could deny his request for a stay, in which case he would be suspended even if he appeals.

The Pats message board is great right now. They're discussing how the case would be split 4-4 if it made it to the SCOTUS. It's fantastic reading if you're bored.

 

 

Next thing you know, they'll come up with Kraft had Scalia bumped off, just in case.

From the Pats* perspective, I would think they would prefer Brady missing three home games, to missing three road games.
