When they're in uniform being paid to conduct themselves as a soldier/sailor/airman/marine is one thing. If they're retired, they're a private citizen. The government cannot condition receipt of a military pension, earned through serving 20+ years in the military, on them forever forfeiting their Constitutional rights.
