Supreme Court Justice Stephen Breyer To Retire

BLUE ON BLUE:

Left splits over Supreme Court pick pushed by top Biden ally.

“While most progressive lawmakers aren’t directly criticizing Childs for her past work, they are making it clear that the balance of power between corporations and the average American worker could prove their litmus test for Biden’s nominee. And on paper, it may be that Childs has the most work to do to meet that test. . . .

Just as there’s a split among progressives in the Senate — with few lawmakers rallying behind a single candidate of their own — liberal outside groups are also divided.

Some are fighting to make sure Biden chooses someone other than Childs, and others are steering clear of backing a specific pick.”

Biden to nominate Ketanji Brown Jackson to Supreme Court

Washington Examiner, by Kaelen Deese

President Joe Biden will nominate federal Judge Ketanji Brown Jackson on Friday to replace Supreme Court Justice Stephen Breyer, which would make her the first black woman on the high court's bench should she be confirmed by the Senate. Breyer announced his retirement last month after 28 years on the Supreme Court, effective when the current term ends this summer. That paved the way for Biden to fulfill his 2020 campaign promise of nominating a black woman as a Supreme Court justice.

fits the job description given by Joe. I guess there’s not much else to talk about.

It's completely unimportant who gets nominated.

The new justice will vote whichever way benefits the Party in every single case.

That business of carefully considering the Constitution and using reason to make the best ruling possible is obsolete, practiced only by a few dinosaurs like Clarence Thomas.

McConnell lowering the Senate confirmation vote for SC from 60 to 50 you will get extremes when either party is in power. Trump put 3 justices thru with only a majority. At least with 60 votes the person needs to be acceptable to both parties and be semi moderate.

Why is she incompetent  ?

Irv is incorrect.

She is NOT incompetent, however her multiple rulings being overturned (some unanimously) certainly point to her following her liberal beliefs and not the law.

I disagree. With 60 required and ever growing extremism on the left, only justices who are varying degrees of liberal would be confirmed. This is very bad as legislating is not the job of the judicial branch.

The sad part about this is that all anyone can see when they look at this lady is her skin color. It’s the exact OPPOSITE of what MLKJr had in mind. Nice job Joe!

Biden honestly shouldn't have announced he was going to do that and just ***** done it.

Repeatedly gets rulings overturned by ignoring the Supreme Law of the Land.  You know.  It’s the document the Dems wipe their ass with daily.  “We the people”.  That one.

What a mess.

"She's only actually published a single decision as an appellate judge, and that came out in the last 24 hours," George Washington University Law School professor Jonathan Turley said Friday , noting it was "a win for unions against a change by federal agencies."

"She has some opinions as a district court judge," Turley noted. "They're quite lengthy opinions. She has been reversed, and the D.C. Circuit [Court of Appeals] reversed her for basically judicial overreach in a couple of cases."

One 2019 case involved an order that expanded the Department of Homeland Security’s (DHS) definition on which noncitizens could be deported. Another overturned case involved a trio of orders on federal employees’ collective bargaining power.

Jackson's DHS ruling was overturned in a 2-1 decision by the D.C. Circuit Court, which said reviewing the DHS policy did not fall under the Administrative Procedure Act.

The judge's ruling on the three collective bargaining orders was overturned unanimously by the D.C. Circuit Court, which ruled that Jackson did not have jurisdiction to adjudicate the case.

"Judge Jackson's record of reversals by the left-leaning D.C. Circuit is troubling for anyone concerned about the rule of law," Judicial Crisis Network president Carrie Severino previously told Fox News Digital. "For example, in Make the Road New York v. Wolf, a D.C. Circuit panel composed of a majority of Democratic nominees concluded that Jackson had set aside a Trump administration rule where there was no legal basis to do so.

"Cases like these suggest that Jackson might be willing in politically charged cases to ignore the law to deliver a particular policy outcome, and that's not what we want to see from a Supreme Court justice."

Senate Republicans are likely to point to Jackson’s overturned cases in their arguments against her being confirmed to replace Breyer.

I still maintain that her confirmation will make little difference to the Court's future.

You must be living under rock. Biden clearly violated the 14th Ammendment to the United States Constitution by appointing a black women to the Supreme Court and purposely excluding all other qualified candidates.  If that's not wiping your ass with the Constitution, I'm not sure what is.  Equal protection under the laws.  Demented fool should be impeached before he dies from old age or the 25th is invoked.  Oh wait.  Then we'll have Kamala.  What a mess.
