Elliott eligible to play in Week 8 after court ruling
A federal judge denied the NFL's request for an expedited preliminary injunction hearing in the Ezekiel Elliott case, ensuring the Dallas Cowboys running back will be allowed to play against the Washington Redskins this coming Sunday.
U.S. District Court Judge Katherine P. Failla confirmed Monday the hearing will take place on Oct. 30 at 5 p.m. ET. If the judge does not grant the NFL Players Association and Elliott a preliminary injunction, he will be suspended again. If she does, his suspension will continue to be on hold as the case makes its way through court.

This is a case where most people agree that the commissioner has the authority to make a determination. I'm confident that at the end of the legal wrangling Goodell's side will prevail. However, there is a bigger issue than having the authority to make a determination without being challenged. That is the issue relating to fairness which in this case is actually immaterial to the appealing process.

 

I don't know if Elliot is guilty or not. When you hear the evidence most fair-minded people will come to the same conclusion that the accusation has not been proved. There is something wrong when suspicions or assumptions are given more weight than the actual facts. There is absolutely nothing wrong with concluding that you don't know what happened. When that happens you shouldn't be ruled guilty.

 

Elliot is undoubtedly immature. He may even be an insufferable jerk. But that doesn't mean that he shouldn't be given a fair hearing based on the evidence. If anyone listened to the telephone tape conversation between the victim and her girlfriend where she is boasting that she is going to make a financial killing in this sordid episode then some reasonable doubt comes into how one views what happened.

 

The real problem isn't that Goodell has unfettered authority in his rulings so much as his judgments are very often stupendously stupid when reviewing the evidence of the cases he presides over.

 

Being an obnoxious jerk shouldn't mean that you shouldn't be treated fairly. That's what happened here. And it's ridiculous!

the NFLPA collectively bargained that so how can they copmplain about it after the fact?
