The statutes in question generally require actual intention. While you may be able to justify a charge under gross negligence, you’d be very unlikely to succeed, or even survive a motion to dismiss.

They were in his garage next to his corvette! Which he has been photographed driving! You’re telling me he never noticed them? Or went through any of them? Good lord are you brainwashed!!!

I’m telling you that you would need more than that to convict. His defense will be that he never opened the boxes. Do you have proof that he did?

Ah so all you care about is what a court of law thinks?  You don't care that Biden had them and what he might have done with them.  He's so trustworthy, right?  Having documents all over the place and in unsecured locations means nothing, it was all just accidental and not his fault.  Congrats, you're exactly how they want you to be.

Of course it makes very little sense that Biden is a victim of a series of unfortunate events spanning his various roles in government, likely with a multitude of different personnel involved, and classified documents held at multiple locations.

That he spoke about this very sort of instance prior to the documents being discovered implies it was top of mind, and certainly his feigned ignorance of wrongdoing is laughable.

It’s fun though to watch true Biden acolytes thread the needle, especially where the garage/corvette is concerned.  The image of a pretentious narcissist who cared more about his dopey car than national secrets says an awful lot about his state of mind.

Anyway, that said, the key to finding the truth here is for the SC to investigate, find out who the people are that Biden and his legal team suggests are responsible for this critical lapse, consider charges against them and see what shakes out.  Someone, somewhere f@cked up, and the list of people responsible has to be very short given the nature of the job and the people they worked for.

Sadly, that won’t happen because as it has been suggested, just about every President from Reagan on—and likely every high ranking Senator or Congressman—would be similarly exposed by a deep dive into this.

Keep covering for these crooks. Better yet, keep your head buried in the sand when it comes to democrats who break the law.

You are trying to discuss an issue with someone who will always hand wave away any and all democrat  behavior. They're always just mistakes, never done with any intent, explained away in a bloviating word salad.

At least @BillStime  @Tiberiusand @redtail hawk just regurgitate the same tired BS, while @ChiGoose actually puts his pretzel twisting mental gymnastics in digital ink while expecting others to see him as neutral and fair.

In that respect he's far worse than the other leftist partisans here.

At least they don't pretend to be what they aren't.

I’m merely stating facts here, sorry if it doesn’t fit your worldview.

Federal prosecutors do not bring charges unless they believe they will win the case.

The law requires intent by the charged individual. Biden’s defense will be that the Vice President doesn’t pack up his own office and he hadn’t opened those boxes or saw the documents since they were moved. The Feds would need evidence to convince a jury beyond a reasonable doubt that this wasn’t true.

Such evidence could include:

1. Government documents in Biden’s personal desk drawer mixed in with items from after he left office; or

2. A letter from Biden’s attorneys saying that he had the documents but will not be returning them; or
3. Testimony from those close to Biden with personal knowledge that he talked about having the documents and/or showed them to others; or

4. Biden himself publicly talking or bragging about still having the documents; or

5. Surveillance footage of people taking documents from those boxes with testimony from those individuals that they were ordered to do so by Biden

Any of those would help convince a jury that Biden knew about the documents and didn’t turn them in.

So far, you seem to be implying that Vice Presidents gain a new sense where they can detect documents nearby. I just don’t think that’s going to fly with even the most conservative jury.

Yup.  Good luck proving what Trump intended to do with the classified information.

Intent was proven when he had his lawyers sign documents saying everything was returned... when that was not the case.

You're no DOC and you're definitely no lawyer.

In fairness, the other day I quoted directly from Mueller and the response seemed imply that he didn’t mean what he said, that he only said it because he couldn’t say anything else, and that when you’re trying to reach a predetermined conclusion sometimes the facts don’t cooperate.

No, but if you can’t prove it, it’s difficult to enact consequences.

I can prove he had documents he should not have had, especially from his time as a Senator.  How they got there doesn't matter in the least to me and again since several troves were found and in wholly insecure and conspicuous locations, I don't care that he returned some initially.  You can feign ignorance and/or make excuses for him, but the facts are what they are and being so naive to think they accidentally ended up there says more about you and your ilk than anything else.

People keep asking why Biden isn’t in trouble while Trump is. That’s what I’m explaining. Trump could have avoided all of these problems if he acted like Biden or Pence. He didn’t, and now he is reaping what he sowed.

I'm sure Hunter tapped out this 22 point email outlining in astonishing detail US strategy in Ukraine, all on his own, between rounds of hookers and blow.

And if you believe that, you just might be a useful idiot like @ChiGoose.

For Hunter, it was an uncharacteristically lengthy email, listing 22 points about Ukraine’s political situation, with detailed information about the upcoming election and predicting an escalation of Russia’s “destabilization campaign, which could lead to a full-scale takeover of the eastern region, most critically Donetsk.

In point 22, Hunter instructed Archer to buy a “burner phone,” presumably to keep their conversations private. “Buy a cell phone from a 7/11 or CVS tmrw and ill do the same.”

It’s a prescient and very well-informed email, unlike anything else Hunter wrote in the nine years covered in the laptop, and it has the distinct flavor of an official briefing, perhaps even a classified one.

Some of the classified documents found in Bidens office were about Ukraine.

An FBI informant has alleged, years ago, that Biden took a 5 million dollar bribe from Ukraine.

And @ChiGoose will still tell you there is nothing to see here.

@ChiGoose

Classified documents found their way into a folder labeled "personal" in Joe Biden's personal office.

Bloviating....intent...bloviating...prove intent...hand waving....bloviating.

The source told CNN that a personal lawyer for Biden was closing out the downtown DC office that Biden used as part his work with the University of Pennsylvania. The lawyer saw a manila folder that was labeled “personal,” opened the envelope and noticed there were classified documents inside. The lawyer closed the envelope and called NARA, the source said.

That’s certainly a bad fact for Biden.

It was spilled there accidentally most likely by a staffer sometime over the course of many years. Hard to pinpoint because others made this happen to Biden so many times.

Here’s the liberal response in order:

It was only Trump who did this obviously.  No President never did nothing like this.  It was only Trump and DOJ personnel literally had to go and find the documents because he wasn’t responsive.

Oh, yeah, I mean, sure maybe it wasn’t only Trump

but Biden didn’t know he had material secreted away in his office because someone else did it, and they’re not at fault either.

Oh, sure, the problem was discovered before the midterms and news not released until after all the voting was in.  These are confusing times and Biden in his zeal to make things right  probably just forgot about the election cycle.

Oh yeah, well sure it turns out Biden had classified documents in multiple places, he was victimized by multiple individuals over multiple years including probably 3 or 4 Penske drivers.   Plus he told the DOJ about the material he held in secrecy for many, many years and they came and got it…end of story.

Well, sure, yeah the DOJ actually found more documents that he and his team had turned over, in a separate location, that he and his team hadn’t found first.  That happens when you don’t know where documents are—who would have thought they would be in the freaking garage???  That’s not on him, or anyone really.
