The bank has to say that, since the payment goes into the trust that services the mortgage-backed security, and the bank can't go to the bondholders and request deference on their payment. Your friend should skip it for now...he'll have to catch up later, but as a practical matter he likely has three months or so before the bank actually does anything about it. And by then, the bank's national office will likely as not have caught up to events and instituted a policy to help homeowners in south Texas.
