He tried thst first. a more credible case is if criminal charges come then followed by a civil case. When civil come first …it says there is a flimsy case so it’s a choice of do you settle for X or sre you willing to pay Y for your legal fee+ possible decision against you.

over 30 years ago I worked as a cashier/clerk in rite aid. i re all one day they tried to do a cigarette selling to minor ring conducted by the police. A kid about 12 come in wanting to buy cigarettes for her grandpa. In back of her I see a shopper behaving oddly where they appear to be looking fir the correct isle a product is on. Most customers are near the aisle end. She was 10 feet back from that. Thrn a few minutes later sge come up saying I’ll buy it for her. I recognize sre as a cop in my jurisdiction so I know what’s up. if this customer was obviously older and buying cigarettes or alcohol and I proof them before selling I can’t be charged….even if the ID was fake.

If police or lawyers were involved in a known illegal act of recording a phone call they should be fired/ disbarred are you saying everything people say must be true he coukd have mentioned and because he knew of people who tested positive for it. false accusations are much much higher than that…especially if you include unreported incidents. um 90% is not beyond a reasonable doubt

Police would have to obtain a warrant to record only if that is allowed under California law without others consent. The police can not just record a phone call without your consent or warrant. Doing so knowingly violates the law which could affect the police careers involved. It’s the same as if police planted evidence on you like slipping drugs in your pocket then claiming the found it on you. Obtaining evidence illegally is in inadmissible in court including other evidence found directly from that illegal act.

it’s actually quite common for young women to claim rape when sex occurs for various other reasons. Sometimes itwas rape, it could have bern regrettable sex or she might have bern impaired somehow and don’t remember. Some come out after where she thought relationship and it was a one night stand. To him. the police doing phone calls is illegal on many levels without consent or warrant. If they did this they should be fired. if he knew about the sex and maybe knew who did it and found out this person has an std would be a wa6 fir him to say to get checked. She might be accusing him because he was a person she remembers or now knows because he got drsfted in the nfl so $$$ reappears in her eyes. if she did a rape kit at a hospital right after the incident the police are informed about this.

Califirnia is a two party consent state so the calls recorded can’t be used as evidence that should apply in civil cases too

Except the tv story seems to imply otherwise. this particular DA might have gotten assigned to the case today. i don’t buy this was not known by the office. This surfaced into the news over a month ago at least. A few months ago thr police got evidence so DAs are usually involved early on in these things.

I thought the report was they got it months ago.

I would assume shortly after she would have gotten an atty prior to any media interviews taking place and they woukd have gotten tapes of the full interview.
