Once a week in Chicago on Thursdays I think... She didn't make the cut but was something like 32nd alternate. NOW, in New York... If they haven't convened one in a a while for this area, I imagine the process is slow to fire up. Got get the jury together and the alternates. The day after Labor Day was only two weeks ago... And it's the gov't... Just imagine how efficient they are with work rules... Gov't pencil pushers, not exactly greased lightning on wheels. Betcha just a few hours a week is considered "productive." Hurry up and wait! LoL... Anyway... Her reviewing fed judge didn't play... Had a phone right on the bench to call people's employers if they were trying to get out of serving. One stockbroker "money man" dude shows up in fancy suit, etc... Acting all important... Total douchebag (wow what a shock)... The judge kicked him out not before berating him left and right... The douchebag probably loved that he got off even after his civic dress-down. NOW, the judge kept people that had handicapped children that needed to be cared for. She said it was amazing just to watch the people come and go... And the ones that tried to bogue out from doing this service. The nice thing about my wife's employer... They would just pay her full salary anyway... And she would just turn in to them whatever piddly amount the feds paid... Same with my job if I get on a jury... Most people aren't as lucky and serving creates financial and personal hardship. I mean... This is the cornerstone of our judicial system and should be taken seriously! It is pretty damn close, keeping it reasonably within the racing surface is all that can be expected. I keep on coming back to the word: REASONABLE. I know it is agonizing for the family of the departed and hard to accept that their loved one screwed up royally. Don't make it anymore painful! Let it go! This will sound harsh, but isn't Ward guilty of his own death like I said a 1,000 times? Why can't they charge the deceased? Yeah, that's like rubbing salt in an open wound. He was criminally negligent resulting in death, his own death, first and foremost. Everybody knows you don't confront a speeding race car, ON FOOT, during a race. It is like walking on train tracks with a speeding train coming. It is UNREASONABLE to think the train can stop in time. It is UNREASONABLE to think that a speeding car can get out of your way. What dream world do people live in? Always a curious goal, because what would "justice" for Kevin look like. It's a tough case to make because criminal negligence isn't a mere departure from reasonableness, but would have to rise to a level of recklessness. Interestingly, this could be one of the rare cases where a criminal conviction may be easier to obtain than a civil suit, depending on the law of the jurisdiction. In some states any negligence on the part of the victim that contributes to the harm bars recovery. In most others the vic must be either less than 50% at fault Or less culpable than the person he seeks relief from. But in a criminal case that defense isn't usually available, although the burden of proof is still higher. Few points I gathered: Ward had marijuana in his system, enough to impair him, No evidence of Stewart swerving to hit Ward. Car was going relatively straight until moment of impact 2 videos, one was YouTube video we all saw, other was tracks official video which was roughly same view but higher quality.
