I would agree with you, if there were not conservatives saying that there should be no exceptions for abortions

There is no "state interest" here in preserving potential life, since there is no potential life.

It is almost a perfect test case for the post-Roe world. Texas will basically be forced to argue that there is a state interest in making a woman have a miscarriage/deliver a stillborn baby/deliver a baby that will die almost immediately after delivery.

Kudos to Kate Cox for leaving the state to get an abortion. Unfortunately, thousands of women in Texas with similar issue (fetus with a fatal diagnosis) might not have the financial means to do the same.

 

And John Devine, along with others like him, is why the GQP will lose in '24.

The Government Accountability Office disclosed in a Tuesday report that $1.89 billion in federal dollars was allocated to multiple different pro-abortion organizations, including those that perform abortion, over the three year period from 2019 to 2021. Planned Parenthood received the overwhelming bulk of the sum, a whopping $1.78 billion, during the three-year period, all while it performed 1.11 million abortions.
