The point you're making (at least the point I think you're trying to make) is valid, IMO. If Brady didn't see him clearly lined up over the line, he likely would not have thrown the INT. He never gets called for intentional grounding, anyway, so my guess is the play is either entirely different, or he just throws the ball in the dirt. There is no way Brady could possibly or physically see him lineup off sides unless hes lined up with the line. And the fact that the penally was even called is complete garbage. If a Patriots player was lined up 4" off sides they wouldn't just let it go. League's a joke. While they're fining NRC 26k, have those 2 refs been fired yet?
