1ManRaid Posted January 6, 2018 Share Posted January 6, 2018 I might want to ditch my shop tomorrow to go over and watch the big game with the people that matter. Problem is I might need a ride. This may sound funny, I have a car (I'm actually just heading to work in a few minutes for my delivery/courier job) but it's in my dad's name, and he's unsure of his ability to drive his vehicles over the border due to a BS lawsuit against him from a couple decades ago from a campground that scammed him. Both of us have no problem crossing as a passenger or even driving other peoples' cars as we've both been over to Buffalo for games and other excursions, he just never got around to asking whatever relevant border authority what his status is for his own car no matter how often I ask him to. I'm not a rich man, but I can probably at least afford the first round of drinks, or whatever you want to work out. I live in St. Catharines, but can probably get to wherever you need me. For what it's worth, I have a clean record (even worked in security), don't do drugs (whatever you do is fine), light drinker, hell the worst I do is vape for medical reasons (just nicotine for my fibromyalgia). 33 year old male who plans to enjoy long walks on the beach to test out my new metal detector for poops and giggles. I do watch the games on my antenna at the shop, but I don't think the atmosphere would be the same as hanging with hundreds of fans going ballistic at that sports bar in Buffalo with the 30 foot TV or whatever it is. If that was the case, there would literally be dozens of vehicles parked at the border waiting to be towed away every day. If your Dad was sued and a judgement was awarded to the campground owner, they would have had to follow that up with a wage garnishment. In some instances, a property execution may have been done but if this happened a couple of decades ago, that's expired by now. They are good for 10 years. They can have it extended for another 10 years but even then it would be expired if it really happened a couple of decades ago. Besides, I'd bet even if there was a property execution and it was still valid, it's not been sitting on the enforcement agencies desk for 20 years so they could jump at the opportunity to enforce it. An arrest warrant is handled a whole lot differently than a civil judgement. Obviously a lot more serious. No such thing as Debtors Jail in NYS. If the circumstances were such that they could justify a Grand Larceny charge or something like that for what happened, that would be a felony in New York. What it is there, I wouldn't know but if similar, definitely an arrest and extradition would be a decision the DA's office there would consider. He was a weasel so I bet he knew he was stiffing them, and I'm sure the casino told/mailed him what he owed after he got home, probably blew it off. But he swore he didn't know he owed or thought it was comp'd or something. So even if there was some sort of 20 year application of a seizure, it would have expired a few months ago. I hope to get in somewhere fairly early, as I'll have my crutches and would like to be able to score a seat, as well as not having to hike a distance to find a place with availability. They can tell him whether there is or isn't any case involving him. It's not going to put you at ease for tomorrow but it will for any future border crossings. It's not an injury, it's a neurological condition that causes my brain to misinterpret nerve impulses as pain and discomfort, to which the body reacts to as if there was injury. Heck I'd even settle for being invited to a random stranger's party (I could maybe splurge on bringing a case) if it came to it as long as the place is filled with friendly Bills fans. You're probably right that it isn't a Federal case but it is very odd if the action causing a lawsuit occurred in Ohio and is then heard in Colorado. In any event, if a Judgement was granted in a Colorado Supreme Court, it would still have to be transcribed in Ohio where the action took place. Neither location is in New York State and the chance that it was also transcribed in a New York court is minuscule, so if it were me, I wouldn't hesitate to cross the border.
