They can think (more precisely feel) what they want.  The report not only didn't exonerate him, it found him guilty, but since he's senile (and/or a liar), they wouldn't be able to prove anything beyond a reasonable doubt.  Which is still a stupid conclusion because if that were the standard, there would never be any not guilty verdicts.

Excellent Just the News Article. I commend it to you.

But there’s a factor the article doesn’t cover.

 

Yes, in correct, classical constitutional theory, this is a bilateral fight between the President as represented by DOJ on the one hand and Congress on the other.

But Biden and the Democrats don’t believe in correct, classical constitutional theory. They believe (or when convenient say they believe) that Special Counsels are independent of the President. They’ve told us so time and again.

But if Special Counsels are independent, then this should be a trilateral dispute — between the President, Congress, and the Special Counsel.

 

Biden being deposed by the Special Counsel should thus vitiate executive privilege. The information elicited wasn’t shared with the Special Counsel for purposes of securing candid advice from a presidential subordinate but for the purpose of investigating the President as a target of law enforcement — and investigating him for acts he didn’t even take while President but instead for acts he undertook as a mere Senator and Vice President — the acts of deliberately taking home classified information during those non-presidential periods.

 

What will the Biden DOJ say on this? They’ll say that Hur left the Office of Special Counsel as of March 11, 2024. So he no longer controls the audio tapes. Convenient, isn’t it? Possession is nine-tenths of the law. And Merrick Garland now has possession.

 

If Hur were truly independent of Biden, 1) Merrick Garland would turn over the audio tapes that Congress wants for the reasons I’ve set out; AND 2) Hur would be complaining to the media and saying the tapes have to go over to Congress because I, Hur, made and collected them as an independent actor. He would say they are not and cannot be privileged for that reason.

But Garland and Hur will not do that. No,  they will pretend, through action and inaction, that advice inside the unitary executive is at stake.

 

See that conceptual 180-degree switcheroo?

 

What this reveals is that the pea of Special Counsels was never under the rock called “independence”; it was instead always under the rock called “subordination.”

 

Hur was not free of President Biden. He was, at all times, a subordinate of the President.

 

This is how the Uniparty works: when a Democrat like Biden is President we get a Special Counsel whom words and deeds reveal not to be independent.

 

But when President Trump is President, we get a Special Counsel who runs rampant and free of the President. Just ask yourself if in 2019 a dispute similar to this audio tape dispute arose vis-a-vis Robert Mueller how fast Mueller would have turned the tapes over to the Dems in the House. And the “Trump DOJ” would have taken no steps to stop Mueller from doing so.

 

What we’re watching in a word is “hypocrisy.”

 

And an illustration of why the Office of Special Counsel is an unconstitutional violation of the separation of powers or a sham to prevent accountability or both.

And it’s both.

 

The Office of Special Counsel (“OSC”) needs to go. 

 

And those tapes need to go over to Congress on a theory either of OSC independence or an estoppel theory that since Biden professed that the OSC was independent, he shouldn’t be heard to take the opposite position now.

Blind & Bias BS as usual !! And you can bet your ass if it was Trump you & your cohorts would be railing for the tape to be brought forward so you could have all the evidence instead of like with this only what you want to keep him from being prosecuted .

 

But your bias is & has been so up front we understand exactly where you are coming from .

Well there is a step in the right direction at least you are finally admitting you voted for someone that is pretty stupid that is the first step in recovery from what i understand ...
