There is no argument. It's pretty crystal clear. the Supreme Court has ruled repeatedly it doesn't matter if they are from El Salvador, Mexico, East Jahunga, The Moon, Mars or Venus. Once they are in the US, lawfully or not, they are considered a "person" under the Constitution and are afforded the same Due Process that anyone else, including American Citizens, have.
