Declassified FISA Opinion Shows More FBI Abuses

A FISA Court opinion and order declassified today reveals continued FBI abuses of “raw FISA-acquired information.” After a DOJ National Security Division review, the FISA Court noted “the FBI’s failure to properly apply its querying standard when searching Section 702-acquired information was more pervasive than was previously believed.”

Judge James Boasberg, who presides over the FISA Court, found little issue with these abuses. In fact, Boasberg concluded:

“[T]he Court is willing to again conclude that the improper queries described above do not undermine its prior determination that, with implementation of the documentation requirement, the FBI’s querying and minimization procedures meet statutory and Fourth Amendment requirements.”

These guys have open game on destroying anyone at anytime, for no reason.

This is some scary stuff.

Gov. Gavin Newsom announced Monday that the state is projected to have a $38 billion discretionary surplus in 2021 — and that he wants to use it to expand the state’s stimulus program by sending additional checks to two-thirds of California residents.

Democratic Death Watch: 'Biden’s agenda is pretty much dangling by a thread'

by John Sexton

Yes, my headline is pretty blunt but no more so than this NY Times piece itself. Last week CNN published a story about the progressive push to get Justice Breyer to retire. There’s was one paragraph in that story which I found particularly striking. It noted that the Senate could fall into Republican’s hands “at any moment” because “two members of the Democratic majority are near or just over 80 years old.” In other words, Democrats are one stopped heartbeat away from losing the chance to replace Breyer with a young progressive.

Today, the NY Times weighs in with a piece that is focused not just on Justice Breyer but the possibility that President Biden’s entire agenda could come to a grinding halt if the wrong people were to die suddenly.

https://www.nytimes.com/2021/05/10/upshot/democrats-agenda-hinges-health.html

“Our ability to make good on Biden’s agenda is pretty much dangling by a thread,” said Brian Fallon, a former aide to Senator Chuck Schumer, the Democratic majority leader. “I don’t think it’s uncouth to talk about it. I think it’s a reality that has to inform the urgency with which we approach those issues.”…

In the most extreme case, deaths could end Democrats’ ability to pass legislation without Republican support — or even flip control of either chamber. That’s more likely in the evenly divided Senate, where a single Democratic vacancy could hand Republicans committee gavels and the power to schedule votes until a Democratic successor was appointed or elected.

A serious illness could also upset the party’s delicate legislative arithmetic. “Schumer needs all 50 votes,” said Mr. Fallon, now the executive director of Demand Justice, a progressive advocacy group focused on the federal judiciary. “If somebody is laid up or is hospitalized for a long period of time and their vote’s not there, then having the majority is somewhat meaningless.”

It’s also possible that a special election or governor’s appointment could shift Senate control more lastingly. Several states require governors to fill vacancies with a temporary replacement of the same political party as the departed senator. But nine senators in the Democratic caucus represent states with Republican governors who can appoint anyone they choose. That could let a Republican governor name a Republican replacement, giving Republicans the majority, even if it may be temporary.

The Times doesn’t even stop at identifying particular Senators who might be at elevated risk of death:

Patrick Leahy, 81, Democrat of Vermont, was briefly hospitalized in January. Thom Tillis, 60, a North Carolina Republican, underwent cancer treatment. Questions have been raised about the health of Dianne Feinstein, 87, a Democrat who has represented California since 1992. Vermont’s other senator, Bernie Sanders, 79, had a heart attack in 2019.

The focus of this story is what happens if one of these elderly Democrats were to die in the next six months or so. Suddenly, it’s possible Democrats lose control long before the outcome of the 2022 elections where Republicans have a real chance to take the House. And if that happens, Biden’s ability to pass big progressive bills is over for his entire first term. So as much as this Democratic death watch seems a bit grim, it really does have the potential to completely alter the course of this administration.

Ultimately, I think this story is being pushed by progressives who are trying to send a message to Justice Breyer. Brian Fallon, who is quoted in the piece, leads Demand Justice, the same group that sent this mobile billboard truck to the Supreme Court last month.

Bluntness is their modus operandi so it wouldn’t surprise me if the entire piece was their idea.

It would not surprise me in the least if operatives in the progressive world didn’t help some of these people along.

It’s amazing, too, the age of some of these geezers and how long they have been in positions of power (D and R).

For perspective, Nixon’s five o’clock shadow and makeup/lack thereof played a part in detailing his chances back in the day.  In 2020, the d race was all about an old commie having a heart attack on the campaign trail v an old moderate-*****-progressive blowing a retinal gasket in a debate and interestingly, that wasn’t even the big issue—an eyeball filling with blood in real time.  The even larger issue was his ability to use words like “it”, “the”, and “God” in the proper context, not referencing his great personal relationships with leaders long dead, and trying to remember who his opponent was without PhDr. Jill’s assistance and guidance.  That his opponent has had arguably the most recognizable name on the planet makes that even more amazing.

BIDEN’S RETURN TO LAWFULNESS:   Biden HHS Secretary Attempts to ERASE a Federal Abortion Law He Doesn’t Like.

Is the Biden administration attempting to unilaterally erase federal law? On Wednesday, Health and Human Services (HHS) Secretary Xavier Becerra denied the existence of the Partial Birth Abortion Ban Act of 2003, a law that bans the brutal procedure of intact dilation and extraction abortions. He explicitly said, “There is no law that deals specifically with the term ‘partial-birth abortion.'” He suggested that Roe v. Wade (1973) would allow such a practice.

That is a grotesque lie and it appears to be an attempt to erase history and the plain text of American law.

In 2003, Congress passed and President George W. Bush signed the Partial Birth Abortion Ban Act. In 2007, the Supreme Court upheld the law in Gonzales v. Carhart. Yet Becerra suggested the law simply does not exist. Perhaps he is still bitter that it passed despite the fact that Becerra himself voted against it.

Despite the coming hysteria and protests , Roe v Wade is NOT under threat.

The Court will simply re-affirm a small section of a ruling that they have already done.

But that won't stop liberals calling for more money.

coincidental?

Wait, so now weaponizing the government is not okay with the Trump-tards?  It is hard to keep up.

Michigan’s push for permanent COVID-19 rules sparks battle with business leaders

Gov. Gretchen Whitmer has laid a clear path for Michigan to eliminate its COVID-19 health order and associated restrictions: Get 70% of the population 16 or older to have at least one vaccine shot.

But simultaneously, the state is working through a process to make permanent its workplace COVID-19 rules, enforced through the Michigan Occupational Safety and Health Administration.

Iowa Governor Signs Groundbreaking School Choice/Mask Ban Bill

The slow march back to sanity made a pit stop in Iowa on Thursday morning.

Governor Kim Reynolds signed a bill that bans masks in schools for faculty and students. The move comes as school boards across America begin wrestling with 2021-22 school year openings in the face of dropping COVID numbers and rising vaccinations.

But that march to sanity didn’t stop there. Perhaps equally or even more important, the anti-mask mandate was just one part of a larger bill that expands charter school access, tax credits and open enrollment. Banning masks (which many teachers say greatly hampers learning in the classroom, particularly among young students just learning sounds and literacy) and allowing parents and their children more educational options using their own tax dollars now puts Iowa at the forefront of putting the needs of students ahead of government.

House File 847 includes several elements of the governor’s original “Students First Act,” including the creation of a “flexible student and school support program” to help schools with innovation; expanded tax benefits teachers; a boost to Iowa’s Tuition and Textbook Tax Credit; and, an expansion of open enrollment eligibility. “We recognize the need for flexibility and choice in education, and this is part of Gov. Reynolds‘ Students First Act to help with those challenges,” said Rep. Holly Brink, R-Oskaloosa, the bill’s floor manager.

Governor Kim Reynolds calls the bill a great step in giving parents back “control” when it comes the education of their children.

ONLY THOSE WHO DIDN’T WANT TOWho Didn’t See This Coming?

Crime is up, especially violent crime, in Democrat-run cities where the “defund police” movement found a receptive audience in government. Now, the Times reports, “The surge is prompting cities whose leaders embraced the values of the movement last year to reassess how far they are willing to go to reimagine public safety and divert money away from the police and toward social services.”

It’s hard to care, honestly. I grew up in Detroit, once the economic hub of the country destroyed through generational control by Democrats. John Conyers represented the city in Congress for 52 years, over which time his district deteriorated to the point that sections of it resemble a third world country. That didn’t happen overnight.

The thing about Detroit is the shell of what once was is still there. You can see the building, empty, architecture today’s craftsmen could not replicate at a price anyone could afford, towering over once beautiful neighborhoods that now resemble abandoned farmland. It’s depressing to see.

So why did the residents of Detroit give the party that orchestrated their demise unbroken power since 1962? Same reasons Chicago, Baltimore, St. Louis, etc., etc., have done it – they’ve been conditioned to think the alternative is somehow worse.

It isn’t.
