What Does "Due Process" Mean?

I presented what I perceive to be the facts, so go ahead and call me an unamerican, libera,l commie, ms13, spouse abuse enabler if you want, because I know some people are going to.  All that aside, the courts feel that he did not receive proper due process for being deported under a wartime act(were not at war), where a street gang is labeled 'terrorist'.  This guy has clearly never TERRORIZED anyone as far as any human has ever documented.  Not even mentioning that he was sent to a prison(for no crime) in a country, which he HAD earned protection from. Oh yeah, the USA literally paid a dictator to put him in that prison.  

 

"DO" process! Love all the energy you're putting into defending this wife beater, human trafficker and gang member. It's a nice look.

Here are the rules the Dems want us to follow:

 

- let in as many illegals as possible, even pay to fly them in

- give them court dates 3-4 years in the future that they won't show to

- try and track them down but you can't ask if they are legal because that's racist

- if they are arrested in a sanctuary city then release them as fast as possible so ICE can't get them

- allow them to wait years for the legal process to take place

- in the meantime they are having kids that are automatically citizens by birth right 

- wait for Dems to get power and grant all of them citizenship anyhow 

 

Is that right? So it's rigged and they want us to play by the rules?

 

How about if you came here illegally then you get deported? Sounds fair to me

Hmph, I thought I was defending the facts of the matter, which you put zero effort into discovering.  In fact, you're STILL blatantly denying them. The good news is, when you're being slandered, I'll be there for ya, buddy.

Yes and no.

 

In his deportation proceeding, yes. The core of due process: (1) notice of what the government is trying to do to deprive you of life, liberty, or property. (2) an opportunity to meaningfully respond. (3) a decision made by a neutral official (at a minimum, not the same person/board that initiated the proceeding. Abrego-Garcia was issued a notice to appear before an immigration judge telling him he was subject to deportation because he came into the United States illegally and didn't have permission to stay. That was uncontroversial. He was given the opportunity to apply for protection from removal as provided by U.S. treaty obligations and statutes. He was given a full and fair hearing. The judge found he was subject to deportation, but that he had shown that it is more likely than not that he would be subject to persecution if returned to El Salvador. The Department of Homeland Security serves as the prosecutor, and they may appeal. They didn't. Therefore, the final order - considered an order of the Attorney General acting through his designated officials - was that he could not be removed to El Salvador.

 

He was removed to El Salvador.

 

I'm not sure whether he was removed under the Alien Enemies Act. It seems like he was, since he couldn't be removed to El Salvador under the Immigration Judge's order. Was he given "due process?" No. He could have been informed that he was being shipped back to El Salvador, in which he would have objected that the judge's order prohibits that. He would've been right. Even under the Alien Enemies Act (I can't tell if it was invoked here), the Supreme Court said 9-0 that you get some kind of process. Maybe it's a quick/easy process in which you can say "you've got the wrong guy, I'm not Abrego-Garcia." Or "I am Abrego-Garcia, but you are subject to a valid order precluding you from sending me to El Salvador." Or "I am Abrego-Garcia, but I don't fit under the Alien Enemies Act because I am not, and have never been, a member of a gang." We'd have to see how involved the hearing would get; that's usually set by published rules. And then some neutral official would have to say "I ratify the removal" or "I find that you can't remove him under that charge." That's it.

 

The Trump Administration violated the law. It is making no efforts to undo it's error.

So this is outrageous, ridiculous, and dangerous to the rule of law (not "democracy;" something more basic, the rule of law). Period.

 

 

 

From anything I have heard he has been deported 2 other times due to violating or breaking the law and being then thought he could just get married to become a US citizen and should have been deported for his past violations and then after he came back and got married he was convicted of spousal abuse so then there's that .

 

This entire thing sounds like the narrative during the "Peaceful Protests" a few years back to which were nothing peaceful at all but twisted by some libs to want others to believe that's what was happening and seeing as 2 different judges have found this person to be in some way affiliated with MS 13 I'd say where there's smoke there's fire ...

What I'm tired of hearing from the same people that cheered on the Biden adminitration ignoring and violating immigration and Customs requirements for entry into the country and what amounts to permanent residence along with their preposterous claims they couldn't stop millions from crossing the border is the insistence that after due process and law we're waived to allow 20 million to cross is their sudden insistence that law and due process must just as suddenly be strictly followed.

The objective is to flood the courts with millions of cases to adjudicate so the courts cannot operate to allow everyone to stay.
