There is no argument. It's pretty crystal clear. the Supreme Court has ruled repeatedly it doesn't matter if they are from El Salvador, Mexico, East Jahunga, The Moon, Mars or Venus. Once they are in the US, lawfully or not, they are considered a "person" under the Constitution and are afforded the same Due Process that anyone else, including American Citizens, have. You may not like or it agree with it, but that's what the Constitution says and how the Supreme Court has interpreted it---more than once.
