Then Pence would be president and he'd be nominating a Supreme Court justice right now. It's hard to tell how it would play out electorally as he could frame it as they "stole a seat" (show viral clips of Graham and Grassley) and any president with integrity would justify that wrong by balancing the court through packing it. -

No but you asked why. I disagree with your second point. Biden's team can now point to all the Republican Senators who promised not to confirm a Supreme Court judge during the last year of Trump's term (Graham, Grassley) and say if they want to play dirty then so can we. -

That's because all they did was replace retired Supreme Court justices and it didn't significantly shift the balance of the court. What's interesting now is whether the Biden campaign will run on packing the court if Trump's nomination gets through. -

There doesn't even need to be a rationale. All the whataboutisms, hypocrisy, increased polarization in Congress, and politicization of the Supreme Court won't matter. McConnel is the majority leader of the Senate who was elected by voters and has every right under the constitution to do whatever he wants with a president's nominee. It's as true now as it was when Obama nominated Garland. Just really bad luck for the Democrats. Just as an observation it's somewhat depressing that the Supreme Court has become so politicized to the point where people (especially pro life activists in this case) cheered internally that another human being died because it was before the election. It's simple human nature when you care that deeply about something and you don't know that person personally. How did we get to this point? -
I'm thinking it's only one to two points without fans (travel and weather). Since the casual bettor still has three for the home team on their mind it might be a great year for sharps.

Romney hasn't commented yet. Murkowski and Collins aren't guarantees but are likely to vote no. Graham (would be hypocritical for him not to play his role as a hypocrite), Tillis, and Ernst are likely yes's. My guess is Murkowski, Gardner, and Collins are the only no votes and Pence casts the tie breaker. It will pass. -
