I'm aware of that argument, too. And I generally dismiss it with the pithy observation that if you can legislate their residency and deportation, they are in fact subject to your jurisdiction. -

However, the 14th was clearly a post-war act to establish the citizenship of freed slaves, and as such it can be argued that the original intent did not include establishing citizenship going forward. No such argument can be made about 8 USC 1401. Which is my point: the statutory argument is stronger than the Constitutional argument in this case, so why even invite the argument by citing the 14th, given Trump can't override either one? -

It's enough to initiate several investigations...but those investigations may just as easily find that O'Keefe staged the whole thing. But again...it's not up to the authorities to prove the accused guilty. It's up to the accused to prove their innocence. So sayeth Senate Democrats. So ***** 'em. -

Yep. I said it earlier this week: no one's thought that far ahead, that these people are going to be placed into literal concentration camps. It's like the organizers are specifically trying to trigger a civil war. I think it's hard to argue as a matter of international law that broadcasting noise across the border is an act of war. I mean, someone would argue it, I'm sure, probably on some crackpot belief that the military is using "assault speakers" that are qualitatively different from my Yamaha floor speakers or something. And I can't wait to laugh at them. I have to add, too, that we have no idea what's going on diplomatically between Mexico and the US. It's possible (albeit highly unlikely, as it would end Nieto's government) that the US and Mexico have an agreement that once the caravan hits the border, the US military can enter Mexico strictly to control the crowd and enforce an orderly crossing of the border, so that CBP can process the asylum requests. (And aside from the Mexican people rioting in the streets over a US invasion, it's a sound plan: Keeps the refugees safe, eliminates any argument that the Army is being used to enforce domestic law, properly enforces immigration law at the border, keeps the situation from devolving into a humanitarian crisis on Mexican soil.) -

It puts me in mind of Romney's campaign in 2012, when the most damaging claims they had against him were "Mitt Romney owns a horse" and the like. With the entire US surveillance apparatus in their hands, that's the worst they found. How ***** dull must Mitt Romney be? -

Do we let them in to the country before we fire on them? Or do we fire on people while they're still in Mexico? Keeping in mind, of course, that even firing tear gas into Mexico is a de facto act of war. -
The distribution of the American Jewish population correlates highly with the distribution of urban liberals. Most Jews are Democrats, your quaint little anecdote notwithstanding. And like most misunderstood socio-economic groups in this country, it's a distinction defined largely by coastal urban vs. "flyover" rural differences.
