I don't want to read too much into it, but there's a few ways of getting to 5 votes against Trump here. Gorsuch's hypothetical (which was my hypothetical, you thief!): what if the President declares a Climate Emergency and puts a 50% tariff on all imported ICE engines? Trump's Solicitor General conceded that that would be legal/constitutional. 2

If the king/president can levy taxes (and a tariff is a tax), an immense power is effectively transferred from the legislature to the executive. And with that comes the spending power too, as the King/President uses that tariff revenue to reward those interests that align with him and his power. We've already seen Trump speculating about using tariff revenue to "compensate" farmers, etc. This is a critical constitutional issue. And even Republicans should understand that - see the example of the Climate Crisis and a huge tariff proposed by a climate activist president. 1
