Barr has been the most vocal proponent of the "unitary executive" theory since Ed Meese. In fact, he's gone well beyond Ed Meese. The honest answer is that one: under the constitution, all of the executive power is vested in the President. Barr is duly appointed as Attorney General, delegated that executive power as it relates to prosecution of federal crimes. The new President, acting through Barr, has decided to dismiss this case in the exercise of that power. If the Dist Ct judge doesn't agree, Flynn may appeal his order. For some reason they shrink from stating that out loud. Presumably they understand that whether or not that is the correct understanding of Article II, the American public doesn't like it. That's why we're in this strange place. EDIT: and if Sullivan disagrees -- says the plea was accepted, the die is cast -- the constitution allows the new President a remedy: a full and complete pardon. Kohl's been doing a great job to allow Sullivan to dismiss and retain his dignity (and not be thought of as totally corrupt). I was (and remain) politically agnostic when it comes to parties. But the more I dug, the more dirt that came out, the more I realized your point above is key. People MUST go to jail for this, otherwise it'll continue. Both parties will do it (they already were), it'll just be a "who's in power gets the toys" kind of set up. This has never been about partisanship, never been about Trump or Clinton or Obama. This has always been about whether or not we are going to live in an actual democratic republic where the People have a say, or merely the illusion of one. It SHOULD be a topic that people can all rally around, especially in this current climate where the country is debating/discussing over-policing and abuses of LEOs. No one is more powerful than the intelligence services in this country (including the FBI in that IC group), and they abused their powers to target innocent Americans to aid one campaign over the other, and then when their opponent won, to attempt to overturn an otherwise legal election.
