The Athletic vs. The Buffalo News: Which Side Are YOU On?

Agreed so far. I like Fairburn's stories but I expected a bit more content. Still, TC is glorified gym class so I'll wait for the reinforcements to arrive... -

Not really. McD values QBs who don't turn the ball over. -

I wonder how many of the folks who're down on Allen's potential watched any of his 2016 game film? If you go by simply his 2017 performance, you can scratch your head and wonder how he could be considered a top-tier prospect. I know that was my initial reaction. It wasn't until I started reviewing the 2016 game video that I saw what makes him an intriguing prospect. It was almost like night and day, IMO. His 2017 team--especially the O-line, but also the receivers and running backs--was dreck. He was constantly on the run and appeared to develop a number of bad habits, particularly with his footwork and constantly ad libbing the play. However, the 2016 Allen was more fundamentally sound and played more within the scheme. That has to be what attracted the Bills the most. Now the question becomes, which guy did they get. The 2016 version that looked like a guy with an NFL future or the 2017 version of EJ Manuel-lite? Time will tell and it may not even be evident this year... -

Oakland...

Maybe. But McCoy's side would have nothing to loose by bringing suit and arguing otherwise. The justice system is crap shoot, particularly on the civil side...
-
That's a stone cold given. And this whole thread would be moot if that were to occur. But the hypothetical that Goodell would add Shady to the "list" in the absence of such evidence is the bone of contention. I don't think he could/would, while others think the Commish would go down that slippery slope.. Time will tell...

The CBA doesn't supersede labor law related to wrongful termination. Or civil law related to loss of employment and damage to reputation. Whether the NFL would ultimately prevail in such suits is really secondary. A long, drawn out civil action would generate a lot of negative PR for a group of owners who are already skittish over the kneeling issue. They would much rather make this go away quietly...
-
To date, that's been true. But at some point, the NFL's going to be drug into court, where the justice system will likely neuter some of that power...

The word "conduct" still sticks in my craw. All of the players that have been suspended to date were physically present or linked (Carruth) to the conduct they were suspended for. If Shady's involvement with the events in Atlanta can't be proven, how would there be conduct to suspend him over?
-
McCoy would have nothing to loose by bringing a defamation suit against the NFL, regardless of the CBA. His career would be over, so go ahead and knock over the china. His attorney could get Goodell on the stand trying to explain why he thought McCoy was guilty (absent proof that specific conduct occurred) and the NFL would want nothing to do with that, IMO...

Unless the league can make a case for Shady's direct or indirect CONDUCT, it will not be able to invoke Article XI...

Not really. In today's 10 second attention span world, the "cat's" already receding into yesterday's news. Hence, the need for Cordon's lawyer to go on CBS today and rekindle their claims. About 20 pages back I advocated for McCoy's lawyer to make a statement to cut off the one-sided media positioning in this case. I'll now admit that I was wrong. Shady's silence is making the story go away rather than be litigated in the press (the old "...sound of one hand clapping" strategy seems to be working). OTOH, if Goodell were to suspend McCoy without credible evidence of his involvement, I suspect Shady and the NFLPA would launch a deep-pockets test case against the commissioner's God-like status and unlimited powers. It could get messy, as any suspension would essentially end McCoy's playing career. So go big, or go home on using that high-powered attorney he hired...
-
Yes. But the owners also very adverse to bad-PR. I could see Shady's lawyer bringing a nasty, high-profile case against the NFL that the league would (obviously) like to avoid...
