After hearing the evidence it's clear he didn't just start shooting indiscriminately. While not completely analogous....that would be like saying when a guy breaks into your house and threatens to slit your kid's throat, that kid cannot shoot them because they're too young to fire a gun. No it is. The kid in your example didn't illegally take the the gun to an active riot.
