Democrat members of Congress-- including Senators Elissa Slotkin

and Mark Kelly-- just released a video encouraging members of the

military to defy orders from President Trump.

 

The party of "NO KINGS" is now encouraging a military coup.

 

 

 

"Yes, it is a federal crime in the United States to attempt to induce members of the U.S. armed forces to disobey lawful orders.

 

The relevant laws are found in two main places: 18 U.S.C. § 2387

– Activities affecting armed forces generally (part of the broader “seditious conspiracy” and interference statutes, originally from the Espionage Act era and updated over time): Subsection (a) makes it a crime to knowingly: advise, counsel, urge, or cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States, or distribute any written or printed material that does so.

Penalty: Fine + up to 20 years in prison.

 

Article 94 of the Uniform Code of Military Justice (10 U.S.C. § 894) – Mutiny or sedition:Specifically criminalizes any person subject to the UCMJ who, with intent to usurp or override lawful military authority, attempts to create revolt, violence, or disturbance, or who solicits or advises another service member to commit mutiny or sedition. But civilians can also be prosecuted for aiding or encouraging this under federal civilian law (18 U.S.C. § 2387 or § 2388).

 

Key court interpretations and historical applications: The statute has been upheld as constitutional when applied to speech that is directed to producing imminent lawless action and likely to produce it (Brandenburg v. Ohio, 1969 standard applies to First Amendment challenges)."
