I think the reason that the only people not required to sign affidavits as part of the investigation were the justices themselves is because Roberts suspects that actually finding the leaker would implicate a Justice. And the only thing worse than not actually finding the leaker is the public finding out that a Justice was involved.
  2. I mean, obviously false. But it does illustrate that kinds of things people come to believe when they isolate themselves in bubbles.
  3. While it should be possible for a minor to override parental consent in some cases, the burden for doing so should be very high. Also, this whole “anyone I disagree with is a commie / Marxist / fascist” crap is childish and unserious. It says more about the poster than whoever they are talking about.
  4. I’ll preface this with the fact that when Dobbs was first leaked, I assumed it was a liberal clerk. But the fact that we don’t know who it was by now, and that the investigation seemed to have been half-assed, combined with what we know about the law and the dynamics within SCOTUS, makes me think that the liberal clerk theory is no longer the most likely explanation. I think that Roberts (and maybe Kavanaugh) was trying to grant the relief asked for in the case (weakening Roe and allowing for the 15 week ban) without going for a full overturning of Roe. That fits his M.O. as an institutionalist who prefers to slowly boil the frog and avoid generating public outcry with a big decision. He likely wanted to cut Roe apart piece by piece over the years, avoiding the big headlines and the mess the GOP finds itself in today. The Dobbs opinion itself is very poorly written. It reads more like an online screed than a court opinion. It also grants relief that really wasn’t sought in the case itself (a full overturn of Roe). I think the initial vote had 6 justices voting for Mississippi but that Roberts was trying to shift the final outcome away from Alito’s screed (which he knew would damage the court and cause problems for the GOP) for a more “moderate” outcome of allowing the 15 week ban. Knowing this, I think someone on the conservative side leaked the draft to lock the votes in place. If Roberts, Kavanaugh or anyone else changed their votes after the leak, it would imply that leaking opinions can change votes, something Roberts would be very much against. At this point, most of the legal experts seem to believe the leak was from the conservative side for the above reasons (plus a couple other reasons).

  6. Not “an expert.” The accepted practice of the medical community as a whole. I’m not saying we should go with whatever a single doctor says. I’m saying that if the AMA, APA, AAP, and all of the major medical organizations agree on a standard of care, the government shouldn’t criminalize it.
  7. I think that the barrier for a minor to receive medical treatment without parental consent should be high, but surmountable via a mechanism such as court action. If a 16 year old requires a blood transfusion to survive but their parents opposed it due to personal beliefs, should we let that child die? I would hope not. However, to override the lack of parental consent, there should be a process and a significant burden that needs to be overcome. Any medical professional who preys on minors should be punished. Any medical professional who does things not within the accepted standards of care should be punished. It’s not my standard of care. I’m not a doctor and I don’t set policy.   8. Of course. When doctors stray from the accepted standard of care, they should face consequences. A lot of the panic around gender affirming care is based on scaremongering either ignorance of what care actually is, or holding out violations of accepted care as the standard as opposed to the exception.

  10. Well this is a strawman right out of nowhere. I believe what I have stated multiple times here: doctors should be able to provide the accepted standard of care with informed consent (parental or guardian consent for minors) without risking being charged with a crime by the government. I do not believe we need the government in the doctor’s room.
  11. Because the Dems almost always find a way not to do the hard thing, even if it’s right. And if the Dobbs leak was a liberal clerk, it would already be public. That was a sham of an investigation. If Roberts could have nailed a liberal clerk to the wall, he would have.

  13. The issue that the GOP has is that a significant part of their base is in a cult of personality with someone who is the archetype of Narcissistic Personality Disorder. Trump doesn’t care about expanding the base because he doesn’t care about the GOP. He doesn’t plan two steps ahead. He just does the thing that feels good to him in the moment regardless of the downstream consequences. There are some in the GOP who have identified the problem you point out (remember the 2012 autopsy?) but they are not in control. It used to be that the traditional conservatives would play footsie with the nut jobs like the John Birch society to keep them in the tent and get their votes. Now, the lunatics are running the show and they are running it straight into the ground.

Post- vaccines, the excess death rate gap between Republicans and Democrats widened from 1.6 pp (22% of the Democrat excess death rate) to 10.4 pp (153% of the Democrat excess death rate). It is true that you were more likely to die during the pandemic if you were a Republican. That being said, I think Dobbs will have a far bigger impact in 2024 than the excess GOP deaths.

The process playing out: The Chief Justice, coming off of his sham investigation of the Dobbs leak, does absolutely nothing of substance but releases a statement saying he has full confidence in Thomas. Maybe throws in another token sham investigation to pretend he looked into it and cleared him. The Dems, instead of using the Senate judiciary committee to investigate whether or not there is even more corruption or improper behavior from Thomas or any other Justice, point to Roberts’ statement as a justification for doing nothing. Thomas keeps on raking it in. The rest of us wonder how many other justices have been bought and paid for (who paid off Kavanaugh’s debts?).

  20. If Russia stops fighting, there’s no more war. If Ukraine stops fighting, there’s no more Ukraine. It’s not they people want war. It’s that they want Ukraine to survive and they don’t live in some fantasy world where a terrorist state that is currently murdering civilians is going to suddenly negotiate in good faith unless it’s been beaten so badly it has to. Anyone thinking a long lasting peace deal can be achieved now, without Ukraine further bloodying the Russians and forcing their retreat, is just not living in the real world.

  24. Early on, the expectation was that Russia would roll Ukraine and decapitate the government within days of launching the war. In the face of that, it would be understandable for Ukraine to want to broker a peace deal even if they got a bad deal. Since then, Ukraine has proven effective at combating a Russian army that is weak from corruption and ignorance. Ukraine now hopes to regain all of its territory, not just what has been taken in the last year. In addition to that, the Russians have been committing atrocities and war crimes. From torture and mass murder in places like Bucha, to beheading POWs and other horrors. Given that and Russia’s lack of trustworthiness, any peace deal signed now would likely only serve to buy Putin time to reorganize and resupply his forces before violating the deal and continuing his murderous rampage. So why would Ukraine sue for peace now? And what would we gain by pressuring them to do so? It doesn’t make any sense. If Ukraine can gain the upper hand with its upcoming advances, it might put itself in a position where Russia will have to listen to its demands. In the meantime, asking for “peace” is really just asking to give Russia more time to organize and kill more people.
