Kevin McCarthy says it’s stupid but when the Republicans passed the Tax Cuts and Jobs Act, they drafted IRC 682 so the payments to a spouse would only count if a husband paid amounts to a wife.

 

The IRS had to clarify this that the word husband also means wife and the word wife also means husband: https://www.irs.gov/pub/irs-drop/n-18-37.pdf

 

So it’s not like this isn’t something the GOP hasn’t already messed up.
