Originally she was not charged with anything as her accident was viewed not as criminal but rather by the sheriff as "poor judgement which is not a crime". My point was that it's stupid to have a law covering every specific thing someone can be doing behind the wheel (ie: cell phones while driving), when we already have general laws that cover these sorts of things. Jack - I read the article. Specifically this part: ""In our society, distracted driving has become an epidemic," Foreman noted, adding that he hopes the notoriety surrounding the case might help discourage motorists from driving while performing other tasks." If a police officer sees you painting your nails while driving (or texting on a cell phone), you're going to get pulled over and ticketed. If you kill someone while painting your nails (or texting on a cell phone), you're going to jail. We didn't need a law barring people from painting their nails to successfully prosecute this woman.
