Why'd she get any time in jail? Is there a law for "no painting your nails while driving?'

 

(sorry, still ranting against the "no cell phone" laws, which are stupid and already in the books under "inattentive driving").

You don't know half the story here. Lots of pressure was brought by the biker community. Over 20,000 hits on HD forums alone. Originally she was not charged with anything as her accident was viewed not as criminal but rather by the sheriff as "poor judgement which is not a crime". Public outrage was the only reason she was charged

My point was that it's stupid to have a law covering every specific thing someone can be doing behind the wheel (ie: cell phones while driving), when we already have general laws that cover these sorts of things.

 

Jack - I read the article. Specifically this part:

 

""In our society, distracted driving has become an epidemic," Foreman noted, adding that he hopes the notoriety surrounding the case might help discourage motorists from driving while performing other tasks."

 

If a police officer sees you painting your nails while driving (or texting on a cell phone), you're going to get pulled over and ticketed. If you kill someone while painting your nails (or texting on a cell phone), you're going to jail. We didn't need a law barring people from painting their nails to successfully prosecute this woman.

The sentence will keep her in the Lake County Jail at night, though allow her to be free during the day to work, receive medical care or mental health counseling and perform community service.

 

That's a pretty cushy 'prison' sentence for killing someone. She wouldn't have got that deal if she had drunk 3 beers instead.
