Now I get it. And Ed know cops are not your friend. Don’t say *****. Pontificating ok so the reason for the statement of “under influence other than alcohol” by the cop likely comes from Ed’s admission of taking Adderall. And for the other reason for saying no drugs where found. that would have allowed for easy getting off the warrant for the blood draw. however IF my friend is right of the .03 and no other drugs then there goes the DWI charge which in turn loses the gun charge. now let’s say my friend is right and the BAC is under the limit. Texas COULD choose to Prosecute a DUI (though that is typically held for Minors). when everything is said and done I think this is what will occur. Oliver will plead guilty to Wet Reckless (traffic violation), he will pay the max fine on the DWI and Gun as part of the plea. Likely will get hit with some community service as well as part of the plea. (That ends the legal part). Now with Wet Reckless you have to say alcohol was involved and admit to that legally as part of the plea. That will trigger the 2 game suspension. The Adderall Admission (unless it was found in his system with the blood test) will maybe add a game. The Gun charge could add a game. initial suspension likely will be 4 games (2021) and entry into stage one of the NFL Substance Abuse program. Those 4 games likely reduced to the original 2 as part of the first time offender NFL DWI policy.

It isn’t. HIPPA laws are on those that have the requirement to PROTECT the Information. I can tell you he had NO obligation to protect the information. just like I can walk into a hospital. And if I see a Chart I can take the picture and release. HIPPA does not apply to me. so yes the Hospital Violated HIPPA. My Buddy didn’t. additionally HIPPA won’t apply because this incident falls under 2 of the 12 National release priorities Law Enforcement Criminal Proceedings

not really true. Can you be Arrested for Open Container in Texas? Texas law says that you can only be issued a citation for an open container violation. However, if there is another violation the police could charge you with, then you can be arrested for that violation. so Oliver’s case the DWI makes the Gun and the Open container also arrestable Could but unlikely as DUI is normally used for Minors In Texas, DWI is a more serious crime. DUIs are only charged to minors under the Texas Traffic Code. Because a DUI is charged when any amount of alcohol is found in their system, it is much easier to be found guilty, however. DWIs are charged under the Texas Penal Code, which makes it a serious offense. Penalties can range from heavy fines to time in jail or prison. Although you should not take either charge lightly, the consequences of a DWI are more severe than a DUI. No court Date set yet either.

You know there was a mandatory blood draw as part of the arrest right? You know people work in those locations and or do the draw and testing right? and that Leaks happen right?

Yeah If my friend is right these charges will be dismissed pretty quickly as there is no DWI with that BAC. Guess we will find out if my friend is right

I have seen a .09% posted in a UK Bills forum as well. But like said have not been able to find either of those numbers anywhere outside of my Friend and the UK Bills site

Hearing from friends in Houston that his BAC came back 0.03% and no other drugs in system. again just based on them I have not seen it verified or even released in any other location.

I will say one thing As a Captain after my 2nd deployment. I had a lapse in judgement was drinking at a house party While playing poker. Thought good enough to drive home. got pulled over. Thankfully the Cop cut me a break pulled my truck into a parking lot and called me a cab. Told me if my truck is gone before 10am the next day when he comes off shift he will arrest me. (Also in Texas BTW lol). never got behind a wheel again after once sip. Hope this has the same effect on Ed. will always Remember Officer Jonathan Gomez for the Break he chose to give me.

Yep he did and Yep there will the Fine for wet Reckless is 200 bucks. Likely will tack some community service to that. And then the 162k in game checks once the 2 game DWI hits.

agree that along with the case backlog due to Pandemic I expect resolution in 2021 with the suspension if any in 2021. I could be wrong but my educated guess I know in Texas it is one or the other. Now the warrant was probably at the hospital by the time they arrived but that hour or so could mean one or two (at his size) pops metabolized off

Texas has specific DWI certified police that are only allowed to handle DWI stops. Not exactly sure what the training consists of.

everyone focused on the Gun is a little silly to me. let’s take out the dumb decision of driving impaired (allegedly). he get pulled over for a traffic infraction. Gun Un registered. Guess what gets charged? NOTHING.

I have taught EVERY SOLDIER of mine if you are stopped for DWI respectfully refuse the breath test. Make them get a warrant. Even if it takes an hour your BAC will be lower. also with an open container of a pop the Breath Test would push out a very high reading if just took a sip.

yeah the cop blocker edits. Down to 1:48. Look at the description though talks the entire encounter. by reading his encounter notes either no breath test was given because of refusal or because cop said impaired by something other than Alcohol. The entire process was given by a DWI certified officer. there is ZERO Law requiring registration of a firearm in Texas. It is open carry state

With the mandatory blood draw. That will be required if you request or deny the Breath Test (seeing no BAC attached you any of the reports) or that in the Cop Blocker video no breath test given I would guess was refused by Oliver. WHAT I don’t know about the blood is if the warrant that they will have to get is limited in scope (alcohol) by my guess the cop suspecting on tape something other than alcohol would tell me Texas blood warrants are limited scope meaning without justification they will only test alcohol unless can get warrant to include other substances. This is all speculation here because unlike the add on gun charge this is something I don’t know about.

well the cop was talking the drugs immediately. Stated he is impaired by something other than Alcohol. They were setting up the drug charge. however a cop blocker was also there filming. And why the video released ASAP. The reason there are so many cop blockers in this area are the History of corruption from the Cops here. not saying these cops did anything wrong (they actually didn’t.). Based on the cop blockers video seemed both sides were respectful. however the intent is established with the statement they wanted a drug bust and where hoping that is what came out of it. However after the search there was none. I have had my dealings with the Montgomery PD. To like all those here vilifying Oliver I am using my experience with this PD and their long line of dirt on them and pontificating

Exactly they do. They know the DWI will get pled out and the weapon charge Buh Bye. So talk the tape (remember Body Cam) and a COP blocker there. hence he don’t think he is impaired for Alcohol. They wanted the drug charge. Good on Oliver not having drugs.

Why request a vehicle search. They were looking for the drug charge and were hoping they would find it. Instead they found the add on gun charge I know I never said anything wrong with the search either. It is clear they wanted the drug charge. Just couldn’t get it. Most of the time in that specific location of Texas they probably do get the drug charge as well.

Officer reported Under the Influence of something don’t think alcohol. And then other statement we conducted search found no drugs. standard statements of Texas PD looking for a Drug Charge.
