That may be true, but the reason it is true is because those certain segments of the population are at a disadvantage, and the reason they are at a disadvantage is because of poor education, and the way to address that is to provide better education and the way to provide better education, is to increase federal spending for teacher salaries.

     

    Not sure why this isn't obvious to everyone.

  3. I haven't read every post in this thread, but I can't believe the overall sentiment that seems to be here. It seems that the general feeling in this thread is sympathy for Zimmerman, hatred for the media, and a lack of understanding of why this might be a big deal or why anyone cares. Is there not a single black person who post at TBD? Or at least has a friend who is black? The black community hears a story of an unarmed black kid walking through a neighborhood, eating skittles, talking to his girlfriend on his phone, then ends up shot and killed and nobody understands how this can stir up emotions within a community that has plenty of members who have behaved perfectly well throughout their lives but still have countless stories of harrassment that their white counterpart wouldn't have? For some there is a justifiable lack of trust of law enforcement and the justice system and this incident just rips open old wounds. I'm no legal expert, but there seems to me that there is enough evidence that this should have been brought to trial. And my sympathies are directed to the dead kid who didn't have a gun.

     

    And besides all this, Zimmerman outweighed the kid by 100 pounds. If you claim that you were getting your ass kicked by a 16 year old that you outweigh by 100 pounds then you deserve to go to jail. Because you are a !@#$ing kitty.

     

    I think the general consensus is to not judge the case by the rhetoric (displayed by both sides), the media's biased reporting, and a lack of facts available to the public. Seems logical to me.

    If you are referring to the incident classification by the patrol officer taking the report, then you are misguided. First of all, the patrol officer taking the report does not have any kind of say in that matter. That is the duty of the detective in charge of the case. Secondly, the patrol officer has to list a classification for the incident report. At the time, this is what he classified it as - "Manslaughter". It means nothing - but, I can see how it is being blown out of proportion.

  5. We're still missing the most important detail here, which I think we never will hear, the actual moment of the shooting. Did Zimmerman shoot Martin during this struggle or did Zimmerman shoot him after Martin stopped and was leaving due to the anger of being beaten up (and of course there are other possibilities)? I'm leaning towards the first possibility at this point, but I'll almost guarantee that we never hear it because it would put the story to rest (goodbye ratings).

     

    The moral of the story for me for both Zimmerman and Martin is that if you do stupid things, they are far more likely to end badly (kind of like me deciding to post over here).

     

    By listening to the 911 tapes, it sounds like the shooting occurred contemporaneously with the struggle. There are screams of "help", and gunshot and then the screams cease. The determination of who was screaming is the key. The screams of help show who was in fear for their life. Martin's family claimed it was him. Zimmerman claimed it was him, which was documented in the initial police report. There is a witness who also stated that it was Zimmerman who was screaming.

    HOWEVER, a nuance rests in the "aggressor" language:

     

    776.041 Use of force by aggressor. The justification described in the preceding sections of this chapter is not available to a person who:

     

    (1) Is attempting to commit, committing, or escaping after the commission of, a forcible felony; or

    (2) Initially provokes the use of force against himself or herself, unless:

     

    (a) Such force is so great that the person reasonably believes that he or she is in imminent danger of death or great bodily harm and that he or she has exhausted every reasonable means to escape such danger other than the use of force which is likely to cause death or great bodily harm to the assailant; or

    (b) In good faith, the person withdraws from physical contact with the assailant and indicates clearly to the assailant that he or she desires to withdraw and terminate the use of force, but the assailant continues or resumes the use of force.

     

    There is A LOT of detail in this language but a couple of things stand out that implicate the following questions:

     

    A. Was Zimmerman the aggressor?

     

    Which implicates 2 clarifying questions -

     

    1. Is the act of following an individual against the admonitions of police when the individual being followed hasn't perpetrated any articulable illegal act considered being "an aggressor"?

     

    AND

     

    2. There is an audio tape that suggests that Zimmerman called Martin a "coon." Does that tape say waht it is purported to say?

    IF he called him a racial slur, Zimmerman is the aggressor. Period.

     

     

    Him following someone (something he is legally able to do) in no way casts him as an "aggressor". Disregarding instructions of a NON-SWORN member of a police department - e.g. the 911 operator - is something he is within his rights to do. The 911 operator has no legal authority over anyone. That is what a lot of people seem to be missing. It would be different if that operator was a sworn police officer, but in this case it was not.

     

    As far as the supposed racial slur, how does someone using their first amendment right amount to prima facie evidence that he is the aggressor? Sure, if that is what he said it would be disgusting. It also may go to his state of mind at the time, but in and of itself it does not make him the aggressor.

     

    Otherwise, I am intrigued by your legal analysis.

  7. This is big point #1. It's clear as day on the 911 tape that they tell Zimmerman to NOT follow Martin. Not even 2 minutes into the call the operator tells him not to follow. Wait for the police, and they police will contact Zimmerman when they get there.

     

    The rest of the tape is dripping with Zimmerman setting it up to have some sort of violent confrontation. "They always get away", "he looks wasted", "he's staring at me", "he's coming towards me", "he has his hand in his waste band", "he's coming to check me out, he has something in his hands". THEN STOP FOLLOWING HIM.

     

    He might as well be Jimbo and Ned "They're coming right for us!"

     

     

     

    The problem is, Zimmerman "not handling it well" directly lead to an innocent person being killed. Saying he didnt handle it well is a horrific understatement.

     

     

     

    I'd say the fact that Zimmerman wasn't charged is a pretty clear indicator that the investigation was not performed properly. According to police, they believed Zimmerman's story of self-defense. If we're just going to believe the last man standing, then we have some major problems with the system. Eye witnesses had a different story. Furthermore, every legal analyst so far has said that the minute Zimmerman disobeyed the 911 operator, and continued to stalk Martin, he lost all ability to claim "reasonable force" and "Stand Your Ground". Why wasnt that looked into? The police "investigation" is exactly why we are where we are.

     

    Being from the Central Florida area, and a law enforcement officer, maybe I can shed some light onto the procedures/protocols in place here. In cases such as these, where self defense is claimed as justification to shoot someone it is protocol to send the investigation to the State Attorney's Office to let them investigate. These cases are typically sent to the grand jury by the SAO for the indictment. This is the exact procedure that has been followed in this case. This case has been blown into the public consciousness for one reason, and one reason only: race. Incidents like this happen all too often, and they are handled in the above manner. We, as the public, rarely hear about them because it isn't of interest to the media unless they can get a frenzy whipped up. The manner in which it is being investigated is the way it should be - heads are rolling now because the public doesn't understand the process. They want Zimmerman arrested yesterday. What about a proper, full blown investigation, that leads to a justice (conviction at trial or exoneration)? That is the goal here. Whether he is arrested a week from now, or a week ago doesn't matter. If there is probable cause to believe he committed a crime, he'll be arrested.

  8. Every year I hurt bad after a Bill's season. This last one took the cake after that awesome start. But its posts like these that bring me back up and my hope is restored. True Bills fan with passion and draft analysis. We all know and the pros always speak of "missing pieces" just a few missing pieces or a "play or two away from a win" C'mon lets face it, no one thought Giants would be there. NO ONE. Look at Cincy? Perhaps this McNutt guy could be the one to replace the Cowboy Cheerleader's boy Friend? Maybe a Bills coach sees this awesome analysis and fights to get this guy in an earlier round. Maybe this guy is the next Moss? Maybe this guy makes up for the Easly draft tragedy. I love the Bills and I cant f*cking wait for that missing piece or that play maker to come help Fred Jackson. I cant wait for a big time player to compliment Stevie and counter hometown heart breaker "Gronky Kong". Im getting sick of this sh*t.   9. I moved from Buffalo to Orlando in 1990. I'm in Melbourne now, but their are plenty of Bills fans in every town in Florida. That's not an exaggeration either. Even the last game of a 3-win and the Bills' bars are full. Oh, and Orlando is not dangerous. The bad parts are obvious; steer clear and you'll be fine.

     

    It's not? The three women who just vanished off of the face of the earth beg to differ, I'm sure. Oh, and what about the ever increasing murder rate? Orlando IS bad, and it's getting worse. To stick your head in the sand and pretend like its all about the wonderful Mouse House doesn't do anyone any favors. I am telling him like it is. But, what do I know? Regrettably, I live here and I have to deal with the city's fine, upstanding citizens on a daily basis. Job security, I guess...

    No one knows who he is? I'd be willing to bet that most Bills fans do know who he is, since this isn't his first rodeo with the team. If that was a joke, I apologize. It's hard to read your intended sarcasm through a (mostly) incoherent sentence.

We should cut George Edwards cuz he looks retarded with no facial hair, if you're bald you have to at least have a mustache and he doesn't grow one so he gotta go... We should also cut our special teams coach cuz I don't even know or have ever heard his name and don't tell me cuz I don't want to know... We should cut Bryan Scott cuz he got a girly voice... And we should cut Troup cuz he kind of looks like an ugly fat girl... The The problem with the Bills is they need better looking players... If we add better looking guys and better looking cheerleaders and prefferably a couple more Hawaiian players we should be fine... We also can't go wrong with any caucasian guys with long hair cuz caucasian guys with long hair play their tail off... Guaranteed pro bowlers...

     

     

     

     

    Dude, Merriman is not good for the Bills because of what? If he gets injured I'm sure in his contract there's a clause that says he has to play a certain amount of games to get a certain amount of money... There's guaranteed money and then there's incentives... Merriman may not have the stats but when he was in the game is when I last remember us even winning games dude... Him and Kyle Williams going down were big blows for this team that lacks talent on defense... Merriman healthy or not causes double teams which frees up other guys on the team to cause disruption on the line which led to interceptions early in the year so relax with this Merriman hate... The guy gets the team excited to play in the pregame and just his presence on the field helps our team... Seems like you're the armchair GM... You're the one crunching numbers on the other side of the screen... The rest of us juss want some kind of emotion from our players and Merriman brings talent leadership and emotion...

     

    Bruce DeHaven - maybe you should be cut from TSW for your lack of Buffalo Bills knowledge? :D

  13. 3) Let's get to Spiller, shall we? His game stats were good, right? Sure. Well, imo he sucked. He dropped at least 1 crucial pass, and he went down upon any contact at all. He even fumbled his toucdown. The fact that our football team wasted a #9 on him will hold us back for many years. Sorry, it's true.

     

    Spiller's day looks a lot better if CMac doesn't get flagged for a phantom hold, no?

  14. I agree...particularly when he tried to call a timeout at the end of the first half, to make the Bengals punt, hopefully, giving the Bills a chance at a Punt return for a TD. Of course, in that case, it was actually 1st down, not 4th (Chan said an official indicated it was 4th down, but another said it was 1st, he wouldn't have called the TO on a 1st down). Not a big deal, ultimately, but with all the decent return men, and hybrid players the Bills have, you would think (hope) that they have some sort of play that they practice for these type of situations...longshot or not.

     

    Remember the Titans "homerun throwback"? Of course you do, if you are a Bills fan, older than 10. I remember Wychek saying that they had practiced that play a few times, every week, for 2 or 3 seasons...just waiting for the time to use it...BINGO! Right time, right place...

     

    btw- Chan not calling a TO at the end doesn't make me think he doesn't know what he is doing, just found it curious. He is normally pretty agressive...why ditch your last possibility of winning a game? What is the fear, you lose by 7, instead of 3?

     

    Again, the Bengals kicked on 1st down. Calling timeouts would not have gotten the ball back. Forcing them to run 1 or 2 more plays probably would have given the Bengals a chip shot FG or even a TD with the way our run D was playing.
