  3. Of course, because if he gets charged and convicted then it would be another sign of the racism in the criminal justice system. The facts are scarce right now, but as I said before...scary. Hopefully, we learn more. ..but without the societal outrage and pressure, I doubt much more will be released.
  4. The facts, as they are coming out in this case, are scary. The officers heard a "loud sound", Damond approached the patrol car, and she then gets shot. Wow.

  10. Not necessarily true. But, emasculating yourself to the level of fake crying does you no favors in court, either. I guess it depends on what your own pride is worth to you. Row 33 will sell it for a couple hundred bucks.
  11. It makes you look pathetic. Stooping to ridiculous levels to get out of a ticket. My motto: if you cry, you are getting a ticket. This is the exact reason why. You are better off admitting the violation and owning up to it. You have a fair shot at getting a warning from me when you do that.
  12. The moral of the story is don't drink and drive. However, a truly good DUI defense attorney will tell you exactly what eball just said. While it isn't a dog and point show (it understandably looks like one to an untrained observer), that is the BEST defense. You are likely going to go to jail, but it severely limits the states evidence. Regardless, you will be out several thousand dollars. Not to mention the fact that you could have seriously injured or killed yourself or someone else. So, again, the moral of the story is don't drink and drive. Uber is a wonderful thing.   13. Actually McD made a point to tell the media the gory details in his presser today. Thought it was kind of odd, especially given the personal nature of the issue.
  14. You realize that we live in an imperfect, flawed world full of imperfect, flawed beings? All I'm saying is pick your battles. Yes sir, no sir. If he still gives you a ticket, go to court like you did. Debating law roadside will get you no where, number one. Number two, make the stop memorable for the cop and he's much more likely to show up in court. Regarding DUI and the fifth amendment (thanks for getting us back on track!), the fifth doesn't help you in refusing the breath test - otherwise, they wouldn't be able to suspend your license for merely exercising your constitutional rights. Miranda comes in to play in about 1% of my non crash DUI cases. And, your refusal to take the test certainly can and will be used against you to show a consciousness of guilt. I wish I could take you out for a ride along and show you how things work. You might have a different opinion on some things. I might even get you to take that tin foil hat off for a few days.
  15. I was wondering what was taking you so long in bringing up the Q word. Ever think that maybe the so called quota doesn't exist? Ever think that making yourself out to be a pompous ass might lead to you getting a citation that you might not otherwise have received? Just a thought. Right, wrong, or indifferent...cops are not robots (yet). Egos and emotions can get entangled, and when a urinating contest happens on the side of the road, everyone looks like a fool. Someone needs to swallow their pride.
  16. How so? Being in a lane of travel or not is not an element of actual physical control in Florida's DUI statute. Passed out behind the wheel of a running car is plenty.
  17. Whenever you tell this story, the video of the Maine Trooper stopping the guy that goes ballistic always runs through my head. Did you ever get stopped in Maine and get threatened to be summonsed for littering after you ripped a ticket up?
  18. Stopped in the right lane, foot on the brake, turn signal blinking. Tiger asleep with seat belt on. PC affidavit doesn't mention it being in park or not.

  20. Yeah, I'm not here to argue with you. I'm just here to impart some of my own personal expertise on the subject. I've seen what tends to work, and what doesn't work in a successful DUI defense. The main factor is the money you shell out for a high priced attorney and whether or not you get a cop that knows what he is doing. Every thing else is mostly a crapshoot. Refusing the chemical test is guaranteed to get your license taken away for a year, though. Btw, I don't have the interests of the government at heart. That is the prosecutors job. I have the interests of every innocent family tooling down the road minding their own business, while Johnny B. Drunk is sharing the road with them. Seeing death and destruction, and notifying family members that their loved one is gone, has forged that passion in me.
  21. Yeah, great advice. Take a license suspension for a year instead of 6 months for blowing over. Btw-I guarantee you it would take AT LEAST 4 drinks to put Tiger anywhere near a .08. Besides, breath evidence isn't even allowed in court in many Florida jurisdictions, but the refusal to take the test is. Not to mention, I'm pretty sure the video is doing a fantastic job of proving the impairment. Combined with the urine test that Tiger took, I don't think it will be a problem in court. It seems like Tiger is owning up to his mistake, so that's a good sign. Much more respect for that.
  22. The Romberg Alphabet isn't reciting it backwards. It's reciting it from a random starting to stopping point (from c to l, or from h to x, etc).
