Not the side of the road test. I think you're referring to a lab test back at the station. You can't refuse those. Quote

Folks: NEVER agree to a field sobriety test, even if you're stone cold sober. While you're at it, if you face this sort of police harassment, politely ask the officer to borrow their pen, ask them for their badge number, write it down, and most importantly: know your rights. Do not let law enforcement take advantage of your ignorance of the law and of your rights. They WILL try, more often than not. I’m hardly a fan of his but see body cam stuff being released to the public a huge violation of his dignity 3 5 Quote

Guys, basic civics, unless they arrest you, you don’t have to do jack **** for the police other than give them you license and registration, and get out of the car if they tell you. Thats it. You don’t have to blow, you don’t have to dance in a field test, you don’t have to tell them where you are coming from or where you are going. Nothing. They’re temporarily detaining you, depriving you of freedom—they need a reason and even better reason to arrest you. When they have you do all this BS, including just asking questions, it’s all just to investigate and see if you give them a reason to escalate and eventually arrest you. if you get pulled over, all you need to do is get license and registration, tell them you’d rather not answer questions, and comply if they make you get out of car. Nothing more. And if you know you might be close, you are WAY better off doing nothing. They’re just creating evidence. They have the burden of proof not you. Don’t give them of video of them making you look like an idiot. Help your future lawyer out. PS: once they arrest you, you usually need to blow or face an automatic license suspension. MikePJ76 Posted July 30 Posted July 30 Apparently Romo had an open alcoholic beverage on the passenger seat and he was initially pulled over because he was speeding on the right shoulder and passing rush hour traffic. i am all for locking up people who pass on the shoulder….i am all for bad things happening to people who pass on the right in general. The Frankish Reich Posted July 30 Posted July 30 I'm guessing he'll be able to plead this to an open container offense or something similar. And I think that's appropriate since if he was intoxicated (by no means clear) he was still in reasonably good shape to drive. In other words, an error of judgment. I do have to wonder, however, why he's traveling with open mini bottles (that's what it sounds like?) since that's kind of consistent with alcoholic behavior ... Quote

What if you’re passing on the right because some idiot wants to cause issues by going the speed limit in the left lane on a highway? 1 1 2 Quote

I have to say, when SC changed the law to prohibit an open container, I was PISSED that I never knew it was actually legal until then. Just being honest.* *Though responsibly, before I get torched. Growing up in community that seemed to have a lot of alcoholics, the guy does seem to fit the bill for me. Don't know how accurate this is and hope to never find it. In addition to all the above, I’ve been told to kick the officer in the balls when he demands I blow in the tube. (Don’t know how accurate this is but hoping someone tries it and lets us know how it went). 1 Quote

Dr.Sack Posted July 31 Posted July 31 Many people have a drinking problem. Romo has a driving while driving problem. The two aren’t mutually exclusive. Quote
Sierra Foothills Posted July 31 Posted July 31 What's interesting to me (and including the decision by the law enforcement agency to not release any Shanahan video or documents) is that some agencies release bodycam and related videos and other agencies don't. It almost seems like it should never be released unless compelled by a court during a proceeding. Quote
