"He's an impeccable kid," Beane said. "We did a lot of research. I think all teams were aware of the Title IX thing. That was fully investigated by the school...It was one of those where there was zero information saying that this actually happened."

I will trust Beane's research over the word of someone out to make money.

Am I the only one confused about Beane calling it a "Title IX thing" ?

Title IX is about gender equality in sports, I don't see why it would apply to allegations of sexual assault

Isn’t there something where they can’t be charged for something they did before being in NFL?

He can certainly be charged or sued for alleged criminal actions which occurred before he was drafted.  I don't think the league can suspend him for offenses prior to his status as an NFL player.

At least the lawyers waited a few weeks after the kid earned his money before pouncing, really helps the optics lol.

The season can’t get here soon enough.

Also you need to find a lawyer to take a case like this on contingency (I am assuming) and it won’t be worth it to the lawyer unless the defendant has assets.  So the “timing” is likely that.  Civil suits are not cheap, no one is going to pursue one against someone with no money, most of the time.

Also worth noting that she filed a police report back when Hairston was just a visiting college freshman, not a 1st round pick, which counters the notion that this has just been a big money grab.

There is an increasingly common double standard that is happening with these cases on social media, where some of the same people saying "innocent until proven guilty" are quick to immediately pronounce the girl as a lying money grabber. Filing a false report is in fact also a crime so innocent until proven guilty applies in her case as well.

That's what I meant.  Writer her the check and end it.

the fact he was investigated with no charges has made my blood pressure go down. That and Beane saying this was investigated pre draft and found still 1st round draft pick worthy is notable

This drama was not known to me even post draft though just saying.

Beane and Hairston addressed it in interviews post draft. There wasn't a lot of chatter pre draft about it, but Joe Marino from Locked On Bills mentioned he heard of some SA allegations connected to Hairston and that was one thing to look at. He mentioned that pre draft and that was the earliest I heard about it.

Lets wait until he gets a big contract and then sue.  Amazing

So I have zero idea of the facts of this case. But let's pretend for a minute that you were sexually assaulted by a guy and the criminal justice system let you down.

Isn't this EXACTLY how you would go about getting justice?

Maybe not, but for a lot of people this is actually a pretty logical step. You can't get the criminal system to help, use the civil system.

Again, I have zero clue if anything happened, just pointing out that there could actually be logic to this approach.

As an aside, he better be good, otherwise why bother drafting someone with any baggage like this?

All civil lawsuits are by definition money grabs.

So if a tractor trailer rearends you while you're stopped at a redlight doing 60 and puts you in a wheelchair for life thats a money grab? Makes sense to me.

Given the general police track record all across this country of not believing victims, not properly investigating, and not processing rape kits, I'm not sure how much stock I put into "no charges so therefore completely innocent".

And most of that is on regular civilian rapes. When a top athlete in a small college town is involved, they're even more incentivized to sweep it under the rug.

That is what hurt Araiza. SDSU and the local police originally swept the whole thing under the rug because SDSU was about to get a bid to join the PAC-12, and they didnt want to hurt the chances with a scandal. So they just ignored her claims. Had they properly investigated it at the time, they could have cleared Araiza and then it all goes away.

Sounds like more was done here in the Hairston case, which is good. And most of the stuff is public record now so easier to make a determination. But in general, "the cops didnt press charges" doesnt mean much when it comes to star athlete assaults.

whenever this situation pops up years after the fact, have the victim take a lie detector test. may not be admissible in court, but could prevent lawsuits

This didn’t pop up years after the fact.  She reported it to the police immediately.

So, 4 years ago something happened.  He was neither arrested nor charged with anything.  He becomes a 1st round pick in the NFL and is slated to be paid millions et voila a civil suit is filed.  Money grab, All.  Day.  Long.

One more note on this. I'm really happy that Beane got in front of this an mentioned it when he was drafted.

Seems like a lot of due diligence was completed and this will fade away soon.

I'm guessing it is because title 9 includes provisions on how institutions must establish policies and procedures to address and prevent sex discrimination, including sexual harassment and violence.

BLECH

This is Not the news I want to wake up to

and for the record any one who thinks a woman asks for a sexual assault is a creep of the highest order

what a disgusting comment with not a sniff of proof EITHER WAY

it does shine a light on how some people think though

Is this woman an opportunist? Maybe

Maybe not

I'll wait for more facts

what a sick story we not need this MESSY DRAMA

Boooooooooooooo

There aren’t any other facts, the case is 4 years old. She waited till he had money to file suite. That in itself speaks volumes. There was never a criminal case, he said she said with no evidence to back her claim.

These women with their money grabs because they see other people getting paid are disgusting and there should be criminal penalties for it.  They should be put in jail if it's found they are filing false claims. Only way it's going to stop, when there are real consequences for it.

If you want justice you file right away, if you want money you wait until you think you can score more.

What?  In the civil context money IS the justice.  That’s literally how it works.

I just read the complaint linked in the article in the OP.

the gist is he suddenly came into her room uninvited and said he was “high as F,” and then raped her. That is obviously egregious, If true.

The common SA cases on college campuses seem to involve both parties being intoxicated and disagreements over consent. That’s not how this one is being framed.

Describe all of the facts of the case as you know them (hint: the decision by a DA to not press charge on an assault case is not a "fact" of a case, it's the outcome).

You already know that (according to DOJ data) of the 310/1000 cases that are reported, only 50 lead to arrest.  It's obvious that there often is not enough hard evidence for a DA to charge--they don't want to take anything to trial except slam dunk cases.

She reported it to the cops (which less than half of victims do).  It didn't go anywhere. If I'm her, I'm absolutely going to wait until the perp comes into some money and then sue--why not?  Now she is guaranteed his response, unless he settles before he is deposed/discovery.  If he settles then he's guilty.

How many times has Watson been charged with assault, despite over 20 women suing him civily for it?  That's right, zero---yet we are pretty sure he is guilty of it (because he plays for another team).
