The attacks on Thomas and other conservatives are relentless, and their goal is simple and obvious. Liberals have been agitating to pack the courts to little success because, well, it is a blatant ploy to seize power. The next best thing is to pick off the conservative justices and replace them with ones of their choosing. Barring that, they want recusals in key cases to win by subtraction.

 

This is their current goal, although they may try to pack the court if Biden wins next year.

 

If the Left really believed their bullsh!t they would try to impeach Thomas, but that wouldn’t fly. So they are smearing him relentlessly.

 

So relentlessly that all 9 Supreme Court Justices fired back, and Sonia Sotomayor has even broken the silence to defend Thomas.

 

 

It is in this context that Geidner brings up Thomas and political considerations:

 

All of that to say, the Dobbs decision changed America overnight. And we’re still dealing — every day — with the fallout. And now, in the months to come, the six-justice majority could and likely will, on many fronts, continue to move the nation’s laws — and with them the country — to the right.

 

In that context, the questions about the court’s ethics can quickly appear to be based more in politics than in ethics. This was, in effect, much of the Republicans’ response to Democrats’ claims at last week’s Senate hearing on Supreme Court ethics reforms.

 

Much of the rest of the piece argues Thomas’ friendship with Harlan Crow is a problem.

 

Why, exactly this friendship is a problem is complicated, but it boils down to this: Crow is a conservative and Thomas is ruling as a conservative. Thomas, it can be argued, is being bought off by Crow.

 

This is, on its face, absurd. Thomas has been a conservative forever, which is why liberals hate him so much. It may be that conservativism is at the root of his friendship with Crow, but it clearly isn’t transactional. As with all friends, their commonalities bring them together.

 

Clearly, Crow is not buying Thomas’ opinions, because Thomas’ opinions have remained constant for decades. The suggestion is vile.

 

By the way, the whole Sotomayor/Penguin controversy is also absurd. I understand why people are pointing to it suggesting liberal hypocrisy, but her opinions are not being bought either. It’s silly to argue that they are. She is a Lefty and will rule as a Lefty. She sold a book as many others do. She isn’t going to rule in favor of Penguin for money.

 

It’s not that people on the left only care about ethics because of the court’s decisions — although, honestly, that would be fine, too! — it’s that the new majority’s decisions, and the possibility of more of them, are so disruptive to established organizing principles of our modern legal society that they center the ongoing ethical questions surrounding Thomas. That, in turn, has led to broader ethics discussions and reporting about the justices.

 

This argument is refreshing, in a way. Geidner is at least saying the quiet part out loud. The Left is attacking Thomas not because they care a damn about ethics. It’s that they want power.

The Great Left-Wing Disinformation Operation Against the Supreme Court

The past five weeks has seen a flurry of media activity, clearly coordinated, against the right-of-center U.S. Supreme Court.

 

First, the outlet ProPublica began publishing a series of pieces "exposing" the well-known fact of Justice Clarence Thomas' long-running friendship with billionaire real estate tycoon Harlan Crow, and alleging ethical improprieties pertaining to the justice's purported failure to disclose certain information. Second, Politico alleged a conflict of interest for Justice Neil Gorsuch in an old real estate transaction in his native Colorado that involved the CEO of a major law firm. Third, Business Insider relied on a "whistleblower" to allege corruption on the part of Jane Roberts, the wife of Chief Justice John G. Roberts, due to her being a well-compensated legal recruiter. Fourth, The New York Times ran a lengthy and meandering front-page story about the at-times coziness between George Mason University's Antonin Scalia Law School and some of the Court's right-of-center justices.

 

Each and every one of these collusive "gotcha" pieces is left-wing disinformation at worst, and grossly misleading at best.

 

There is absolutely nothing wrong with a Supreme Court justice having a long-running friendship with a wealthy political activist — and Justice Thomas did not actually fail to disclose anything for which extant canons of judicial ethics mandate disclosure, as The Wall Street Journal's James Taranto and others have painstakingly detailed. As for Justice Gorsuch, his stake in the underlying Colorado property was via a LLC, so he too did not skirt any mandatory disclosure rules. As for Jane Roberts, it is not exactly a state secret that prominent legal recruiters, and headhunters more broadly, can rake in lucrative commissions. And the Times' polemic against Scalia Law is little more than a pitiful lament that the Left does not unilaterally control every single top-50 law school in America (although it is perilously close to doing so).

 

Nonetheless, despite these glaring factual omissions, misrepresentations and the misleading natures of these hit pieces, the Democrat-controlled Senate Judiciary Committee still deemed it necessary to hold a hearing last week on "ethics reform." To any reasonable observer not inebriated from that most potent stew of MSNBC chyrons and New York Times editorial headlines, it should be clear that Democratic elected officials are working hand in glove with the Beltway journalist establishment. That particular revolving door, after all, has a long and inglorious history.

 

 

It is incumbent upon sober elected officials, and the American people at large, to reject this obtuse, sprawling Democrat-media disinformation operation. The operation, for all its pompous bluster and ginned up faux hysteria, has one goal and one goal only: to delegitimize the U.S. Supreme Court, and to pave the way for ruinous policies that would irreparably damage, and ultimately destroy, that venerable institution.

 

The current disinformation operation thus amounts to one big, crass intimidation tactic — a flexing of muscle by what the late Andrew Breitbart famously called the "Democrat-media complex." The goal is to browbeat the justices into ruling the Left's way in this term's marquee cases — including the potentially imminent end of America's sordid affirmative action regime in the twin pending cases out of Harvard and the University of North Carolina — or else feel Democrats' political wrath. That wrath could come in numerous forms, including judicial impeachment, jurisdiction-stripping legislation, or, perhaps most harrowing, the ever-looming threat of court-packing.

 

Let us be clear: That is the end goal here. "Ethics reform" is simply a convenient smokescreen — and not a particularly clever one, at that.

The President and CEO of Planned Parenthood, Alexis McGill Johnson, called for packing the Supreme Court and other “judicial reforms” in an interview with Jen Psaki on MSNBC:

 

During an appearance on MSNBC’s “Inside with Jen Psaki,” McGill Johnson told host Jen Psaki that the reason why she’s calling for changes to the nation’s court system is due to recent attacks “on our democratic rights and our democratic freedoms.”

 

This is typical left-wing Orwellian rhetoric. She is talking about the Dobbs decision, which took abortion out of the realm of judicial fiat and returned it to the democratic process, where it belongs. To the Left, democracy is “undemocratic.”

 

McGill Johnson also told Psaki that its time for the Supreme Court to expand the bench and implement term limits for justices….

 

Planned Parenthood also released a statement today calling for “judicial reforms,” and news stories all say that the organization called for packing the Supreme Court, but I haven’t been able to track down the statement itself. The Democrats would love to pack the Court, but they can’t do it when Republicans control the House. They also are mindful of the fact that in 2025, Republicans likely will control the presidency and the Senate as well as the House, and could counter-pack the Court by making it yet larger. This is a rather dangerous road to go down.

 

As for term limits, they would require a constitutional amendment that isn’t in the cards.

 

Johnson also joined in the chorus of left-wingers raising bogus “ethics” concerns about the Court. The leftists’ charges against Justice Thomas are frivolous, and Congress cannot impose a code of ethics on the Court, which is a coequal branch of government. (If it were seriously concerned about ethics, Congress could adopt a code for itself that would prevent insider trading by senators and representatives.)

 

So these are not serious proposals, they are political ploys aimed at stirring up the Democrats’ base and distracting Democratic voters from the disasters of the Biden administration and the fact that liberals no longer even pretend to have solutions to our nation’s problems. Will that work? I don’t know. It did in 2022.

Justice Thomas is not 'compromised',  all of his rulings have been consistent for over thirty years.

The leftist campaign to force Justice Clarence Thomas from the US Supreme Court let its inner clown out when the executive director of the AstroTurf smear group Fix the Courtinadvertently released the names of its donors to a Washington Examiner reporter.

 

Fix the Court has not only been a player in the current attacks on Justice Thomas, but they were also a major participant in the smear campaign directed at Justice Brett Kavanaugh during his confirmation hearing.

Harlan Crow’s Lawyers Say Congress Doesn’t Have Authority to Investigate Supreme Court.

 

Harlan Crow, the Texas billionaire and GOP megadonor with close ties to Clarence Thomas, refused to answer questions from a Senate committee about his years of gifts to the Supreme Court justice.

 

Crow’s lawyers in a letter to the Senate Judiciary Committee argued that Congress does not have “the authority to investigate Mr. Crow’s personal friendship” with Thomas, according to a copy of the letter reviewed by Bloomberg News.

“The Committee has not identified a valid legislative purpose for its investigation and is not authorized to conduct an ethics investigation of a Supreme Court Justice,” wrote Crow’s lawyers, who are from the law firm Gibson, Dunn & Crutcher. They added that the committee is “targeting Justice Thomas for special and unwarranted opprobrium.”

 

They just can’t stand a strong Black man in a position of power.

 

But while Congress has the power to set some constraints over the Court, this mean-spirited and obviously political effort is pretty shady. And I very much doubt that Dick Durbin could withstand the kind of scrutiny he wants to aim at Thomas and Crow.
