Former Denver Broncos offensive tackle Ja'Wuan James is strongly considering filing a grievance through the NFL Players Association for lost wages after he tore his Achilles tendon away from the team facility.

 

James, who was released Friday with a post-June 1 designation, could seek more than $10 million in salary for the 2021 season that the Broncos appear likely won't cover after they designated him with a non-football injury.

 

 

This is NFL's reaction to NFLPA telling players to not go to NFL teams facilities due to "risk of COVID" while at same time not allowing teams to make it mandatory.

James should sue the NFLPA for giving such crappy advice.

I doubt his suing the Broncos would work as it is collectively bargained and players have lost this in the past.  
 

The issue was not what James did, but the NFLPA arbitrarily telling players to stay away without an agreement.

 

James should go after the NFLPA for bad advice, but I am sure like many unions the becoming of a member means you can not challenge their rulings.

Unions can be sued and its officers can be sued just like corporation officers.  

It is likely the NFLPA has coverage for its officers for these type of lawsuits.

Plus  he signed a contract which no doubt explicitly describes non-football injury salary exclusion.

Typically to sue a Union - a member has to first go through the NLRB board and prove misrepresentation.  The NLRB will then review and sanction the Union - then there is an option to sue.  
 

Very, very few lawyers would start out trying to sue a Union because the burden of proof that the Union purposely provided bad representation.  The issue in this case is that the Union gave terrible advice trying to force the NFL away from OTA’s and it will cost 2 of their members their salary and for James that was a significant amount.

yes and they should be compensation by union not teams but they tried to blame NFL and teams for bad advice.

There is no basis to "sue" the NFLPA either--even more so in this guy's case.

 

The entire team released a letter saying they weren't going to show up for OTAs.  These are grown men who made a collective decision.  They weren't forced or coerced into, as a group, deciding not to go.  THEY made a decision that has put at least 2 of their colleagues out of a lot of money.  The Bills players, I'm pretty certain, are represented by the same union, got the same advice from the union.....and showed up to OTAs.

 

The Broncos players certainly understood that if they got injured working out away from the facility, they would be termed "non-football" injuries and lose money.  They made their choice anyway.  Only themselves to blame.

If he's got proof that the coaches instructed them to work offsite...game, set and match!! But he better have something in writing. No other player is climbing out on that limb with him. Non-guaranteed contracts make cowards of us all. 😄

He'll also be trying to prove the boogieman is real. 

 

This is once again, DeMaurice Smith & JC Tretter, making a massive blunder and now trying to resolve is through the 'courts' and they'll lose again. They use these legal proceedings to cover up their incompetence. Maybe stop getting your a**es handed to you in every negotiation you have with the NFL and you won't have to go through with these stupid theatrics.

lol i can't believe he didnt get fired during that lockout year after he never told the playeres they had insurance money to cover the players salaries. then the players took out all those loans and lenders started calling and they caved.  just a monumental screw up
