If the kid is of age then it's not statutory rape, but it could still be a crime based upon her official capacity.

If I'm not mistaken, it's not about the age and they wouldn't go after her for statutory rape, it's because of the position she was in as a teacher and the other person being a student. I believe there are some places with laws against people in certain positions (teachers, doctors, psychiatrists, etc) having relationships with students/patients of theirs because of their position of either taking care of or helping the other person.

 

If he wasnt one of the students in her class, it's probably more of an issue that she tried to cover up and destroy evidence while they were investigating the situation 

 

I found the funniest part about this was how the article mentions in it's own paragraph how much she would be making in her position.
